An Act to Remove Doubts as to whether David THE DAVID JOHN MARLAIS DANIEL VALIDATING ACT OF 1938. John lVIarlais Daniel has incurred any Penal Consequences by Sitting and Voting as a lVIember of the Legislative Assembly, and to Validate "the Election of the said David John Marlais Daniel, and to Provide for his Continuance in Office as a Member of Parliament. [ASSENTED TO 23RD AUGUST, 1938.] Preamble. W HEREAS by section six of the *" ConstitutionAct of 1867" (as amended by subsequent Acts amending the Constitution) it is provided (subject to certain exemptions therein contained) that any person who shall, directly or indirectly, himself or by any person whatsoever in trust for him or for his use or benefit or on his account, undertake, execute, hold, or enjoy in the whole or in part any contract or agreement for or on account of the Public Service shall be incapable of being elected or of sitting or voting as a Member of the Legislative Assembly during the time he shall execute, hold, or enjoy any such contract or any part or share thereof or any benefit or emolument arising from the same; and that if any person being a Member of such Legislative Assembly shall enter into any such contract or agreement, or having entered into it shall continue to hold it, his seat shall be declared by the said Legislative Assembly to be void, and thereupon the same shall become and be void accordingly: And whereas the said David John Marlais Daniel had from·time to time, prior to the commencement of this Act, duly entered into contracts for the sale of tickets in the "Golden Casket" Art Union, and, having been elected as a Member of the Legislative Assembly on the fourth day of April, one thousand nine hundred and thirty-six, sat and voted as a Member of the Legislative Assembly: * 31 Vie. And whereas the said David John Marlais Daniel has been again elected as a Member of the Legislative Assembly on the second day of April, one thousand nine hundred and thirty-eight: And whereas doubts have arisen whether by virtue of the said recited provisions the said David John Marlais Daniel has incurred divers penal consequences: And whereas the infringement (if any) of the said provisions having occurred through inadvertence, it is desirable that such doubts as aforesaid should be removed and that the said David John Marlais Daniel should be indemnified from all penal consequences in respect of his said acts, and that his seat should not be vacated by reason only of such acts- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as "The David John Short title. Marlais Daniel Valida#ng Act of 1938." 2. (1.) (2.) The election of the said David John Marlais Daniel upon both of the aforesaid dates to the Legislative Assembly is hereby declared to have been valid and effectual. (3.) The said David John Marlais Daniel shall be and is hereby indemnified, freed, and discharged from and against all forfeitures, penalties, incapacities, and disabilities which he may have incurred or, but for this Act, would incur by reason of his said acts.

[ASSENTED TO 3RD NOVEMBER, 1938.] B E it enacted by the King's Most Excellent Majesty) by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title and construc- tion. Collective tItle. 1. This Act may be cited as " The Dairy Produce Acts Amendment Act of 1938," and shall be read as one with *" The Dairy Produce Acts, 1920 to 1935," herein collectively referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Dairy Produce Acts, 1920 to 1938." Amendments of the Principal Act. Amendment 2. Section three of the Principal Act is hereby of s. 3. amended as follows :_ (a) A new definition" Analyst" is inserted after the definition " Agent," namely:- -\nalyst.
