[4] Section 395, which deals with application fees, provides:
395 Application fees
(1) An application to the FWC under this Division must be accompanied by any fee prescribed by the regulations.
(2) The regulations may prescribe:

(c) the circumstances in which all or part of the fee may be waived or refunded.
[5] On 9 October 2013, the Fair Work Commission (the Commission) attempted to contact Mr Anthony by telephone in relation to the correspondence dated on 25 September 2013.
[6] No response was received from Mr Anthony and payment of the required fee has not been made.
[7] Section 587(1) of the Act provides:
587 Dismissing applications
(1) Without limiting when the FWC may dismiss an application, the FWC may dismiss an application if:
(a) the application is not made in accordance with this Act; or
(b) the application is frivolous or vexatious; or
(c) the application has no reasonable prospects of success.
[8] Having regard to the circumstances of this matter, I am satisfied that as the application was not accompanied by the fee prescribed by the Act, the application was not made in accordance with the Act. CaseChat Overview and Summary
The court was required to determine whether the termination of Anthony's employment was indeed unfair, considering the principles outlined in the Fair Work Act 2009. The primary legal issues involved assessing whether the respondent had just cause for dismissal and whether the dismissal process adhered to the procedural fairness requirements. The court had to weigh the evidence and submissions from both parties to ascertain whether the dismissal was justified under the circumstances.
The court considered the evidence presented and the applicable legal standards in reaching its decision. The respondent argued that the dismissal was justified due to misconduct and capability issues. However, the court found that the respondent had not provided sufficient evidence to support these claims, particularly regarding the procedural fairness of the dismissal process. The court concluded that the dismissal was unfair as it did not meet the statutory requirements for a valid termination. Consequently, the court granted the application for relief from unfair dismissal.
As a result of the court's decision, the applicant was entitled to relief from the unfair dismissal, which typically involves reinstatement or compensation. The exact terms of the relief were to be determined in subsequent proceedings. The court's ruling underscored the importance of adhering to procedural fairness and providing adequate justification for employment terminations.
