Darling Harbour Land Titles Act 1907 (NSW)

t o a m e n d t h e Real P r o p e r t y Ac t , 1 9 0 0 ;

a n d for p u r p o s e s c o n s e q u e n t t h e r e o n or

i n c i d e n t a l t h e r e t o . [16th December, 1907.]

BE it enacted by wi th t he advice and consent of t h e Legislat ive Council and

the K i n g ' s Most Exce l l en t Majesty , by a n d

Legis la t ive Assembly of N e w South "Wales in	Pa r l i amen t	assembled,
and by t h e au thor i ty of t h e same, as follows :—

1. This Act may be cited as the " D a r l i n g H a r b o u r L a n d Titles

such

Act , 1907 ."

2. W i t h respect to any land included in a purchase ,

appropr ia t ion , or resumpt ion , referred to in or made in pursuance of section two or section three of t he D a r l i n g H a r b o u r W h a r f s R e s u m p t i o n Act , 1900, t h e following provisions shal l apply :—

(a) The Regis t ra r -Genera l shall from t ime to t ime, on t he

appl icat ion of the Secretary for Pub l i c Works , issue to the said Secretary, or to any person appointed by h im in t h a t behalf, a certificate of t i t le unde r the Rea l P rope r ty Act , 1900, to all or any par t of such land, and may so issue such certificate w i thou t causing any examina t ion or repor t to be made as to the t i t le to such land and wi thou t considering

such t i t le . N o contr ibut ion shall be payable upon the issue of any such certificate to the assurance fund as provided in

the N i n e t e e n t h Schedule to the Rea l P rope r ty Act , 1900.

(b) In dealing with such application it shall not be necessary to locate the boundar ies of t he Crown gran t s of any such land, or to prove t ha t such land has been al ienated by the Crown, b u t it shall be sufficient if t he Reg is t ra r -Genera l is satisfied wi th respect to any certificate of t i t le proposed to be issued or issued by him under this Act, in respect of any of such land, t h a t the said land is included in the land purchased, appropr ia ted , or resumed as aforesaid.
