CaseChat Overview and Summary

Danisco A/S (the applicant) sought to register a trade mark, and Sweetlife Australia Pty Ltd (the opponent) opposed this application. The proceedings were heard by Hearing Officer Heath Wilson of the Trade Marks Hearings.

The court was required to determine whether the grounds of opposition raised by Sweetlife Australia Pty Ltd under sections 42(b), 58, 59, and 60 of the relevant Act had been established. Specifically, the court considered whether the applicant was the owner of the trade mark, whether the applicant's conduct involved misleading or deceptive conduct or false representations, and whether the opponent had a sufficient reputation in its trade mark to satisfy the threshold for section 60. The onus was on the opponent to establish at least one of these grounds on the balance of probabilities.

The Hearing Officer found that the opponent had not discharged the onus of establishing any of the grounds of opposition. Regarding section 58, the court noted the established principle that the first person to apply to register a trade mark is generally considered the owner, unless the mark was used prior to the filing date by another party. Evidence from a customer of the opponent indicated the applicant's use of the trade mark since at least 2004. The Hearing Officer determined that the applicant's conduct did not amount to misleading or deceptive conduct under section 52 or breaches of section 53 of the Trade Practices Act, and that the opponent's reputation was insufficient for section 60. Consequently, section 42(b) was also not established.

As the opposition failed, the trade mark application was permitted to proceed to registration one month from the date of the decision, unless an appeal was filed. The applicant was awarded costs against the opponent.
