Dangerous Substances (Safe Handling) Amendment Regulations 2010

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Dangerous Substances (Safe Handling) Act 2005 .25 January 2010

1Short titleThese regulations may be cited as the Dangerous Substances (Safe Handling) Amendment Regulations 2010 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Dangerous Substances (Safe Handling) Regulations 2009 are referred to as the Principal Regulations. 4Regulation 107 amended (Applications for fireworks display permits) Regulation 107 of the Principal Regulations is amended as follows: (a) by inserting in subregulation (7)(b) "the maximum gross weight of Type 2 fireworks that may be procured or used," after "safety,"; (b) by inserting the following subregulation after subregulation (7) : (7A)  The Secretary may only specify in a permit, in a condition under subregulation (7)(b) as to the maximum gross weight of Type 2 fireworks that may be procured or used, a gross weight that is – (a) less than 20kg; or (b) if there is a determination in force under regulation 108(4A) , less than the gross weight specified in the determination. 5Regulation 108 amended (What does a permit authorise?) Regulation 108 of the Principal Regulations is amended as follows: (a) by inserting the following subregulation after subregulation (4) : (4A)  The Secretary may determine, in writing, that the maximum gross weight of Type 2 fireworks that may be procured or used under fireworks display permits generally is a maximum gross weight, specified in the determination, of less than 20kg. (b) by omitting the definition of allowable quantity from subregulation (5) and substituting the following definition: allowable quantity, of Type 2 fireworks for a fireworks display permit, means – (a) if no determination is in force under subregulation (4A) and no condition as to the maximum gross weight of such fireworks that may be procured or used is specified in the permit under regulation 107(7)(b) , a gross weight of 20kg; or (b) if a determination is in force under subregulation (4A) and no condition as to the maximum gross weight of such fireworks that may be procured or used is specified in the permit under regulation 107(7)(b) , the gross weight specified in the determination; or (c) if a condition as to the maximum gross weight of such fireworks that may be procured or used is specified in the permit under regulation 107(7)(b) , the maximum gross weight specified in the permit.
