  1. Name of regulation

    This regulation is the Dangerous Substances (General) Amendment Regulation 2015 (No 1).

  2. Commencement

    This regulation commences on 15 May 2015.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Dangerous Substances (General) Regulation 2004.

  4. Section 338, new definition of licensed asbestos assessor

    insert

    licensed asbestos assessor—see the Work Health and Safety Regulation 2011, dictionary.

  5. New sections 341 and 342

    in part 3.5, insert

  6. Owner must get living area asbestos contamination identification report

    An owner of affected residential premises must arrange for a licensed asbestos assessor to—

    (a)inspect the living area of the premises; and

    (b)identify any loose-fill asbestos contaminated dust or debris (asbestos contamination) in the living area; and

    (c)prepare a report about any asbestos contamination found.

    NoteIf a form is approved under the Act, s 222, for this provision, the form must be used.

  7. Living area asbestos contamination report lodgment

    (1)This section applies if a licensed asbestos assessor prepares a report under section 341 (c).

    (2)The licensed asbestos assessor must give the report, or arrange for the report to be given, to the regulator.

    (3)In this section:

    regulator—see the Work Health and Safety Act 2011, dictionary.
