  1. Name of regulation

    This regulation is the Dangerous Substances (Explosives) Amendment Regulation 2009 (No 1).

  2. Commencement

    This regulation commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Dangerous Substances (Explosives) Regulation 2004.

    NoteThis regulation also amends the Magistrates Court (Dangerous Substances Infringement Notices) Regulation 2004 (see s 13).

  4. Section 7 (1), definition of explosive, new paragraph (e)

    before the note, insert

    (e)a firework.

    (2)A firework is a dangerous substance.

    Note 1Licences are issued under the Act, ch 4 (Licences for dangerous substances).  Fireworks are dangerous substances (see s 8 (2)).

  2. New section 277A

    insert

277ASupply of consumer fireworks—limited quantity

(1)A person commits an offence if—

(a)the person supplies consumer fireworks to a consumer at premises; and

(b)the quantity supplied to the consumer at the premises in a single day is more than 25kg.

Maximum penalty:  30 penalty units.

(2)An offence against this section is a strict liability offence.

NoteA reference to a quantity of explosive by weight is a reference to the gross quantity of the explosive (including the packaging) (see s 21).
