Regulations 1998

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1. Objective

The objective of these Regulations is to amend certain regulations made under the Dangerous Goods Act 1985—

(a) to alter certain references as a result of amendments made under the Accident Compensation (Occupational Health and

Safety) Act 1996; and

(b) to make other minor administrative changes.

2. Authorising provision

These Regulations are made under section 52 of the Dangerous Goods Act 1985.

PART 2—DANGEROUS GOODS (EXPLOSIVES)

REGULATIONS 1988

3. Principal Regulations

In this Part, the Dangerous Goods (Explosives)
Regulations 19881 are called the Principal

Regulations.

4. Amendment of definitions

In Regulation 105 of the Principal Regulations—

(a) in the definition of "approval", for "Director- General" substitute "Authority"; and
(b) after the definition of "AS" insert— ' "Authority" means the Victorian

WorkCover Authority established under section 18 of the Accident Compensation Act 1985;'; and

(c)

in the definition of "protected work", for and

(d)

in the definition of "special packing "Authority".

5. Amendment of references to Director-General

In the Principal Regulations—

(a)

in regulations 108, 109, 110, 204, 206, 319, 556, 558, 559, 560, 562, 710, 728, 803, 820, 1002, 1005, 1006, 1113, 1171, 1205, 1206,

1207 and 1301 for "Director-General"
(wherever occurring) substitute "Authority";
and

(i)  in item 1, for "signed by the Director- General" substitute "approved by the Authority"; and

In the Principal Regulations—

PART 3—DANGEROUS GOODS (LIQUEFIED GASES

TRANSFER) REGULATIONS 1987

7. Principal Regulations

In this Part, the Dangerous Goods (Liquefied
Gases Transfer) Regulations 19872 are called the

Principal Regulations.

8. Amendment of definitions

In Regulation 4 of the Principal Regulations—

(a)

in the definition of "Approved", for and

(b)

after the definition of "AS" or "Australian ' "Authority" means the Victorian

WorkCover Authority established under section 18 of the Accident Compensation Act 1985.' .

9. Amendment of Principal Regulations

In regulations 7, 29 and 30 of the Principal
Regulations for "Director-General" (wherever

occurring) substitute "Authority".

HANDLING) REGULATIONS 1989

10. Principal Regulations

In this Part, the Dangerous Goods (Storage and
Handling) Regulations 19893 are called the

Principal Regulations.

11. Amendment of definitions

In regulation 107 of the Principal Regulations—

(a) in the definition of "approval", for "Director- General" substitute "Authority"; and
(b)

in the definition of "approved", for and

(c)

after the definition of "assessment factor" ' "Authority" means the Victorian

WorkCover Authority established under section 18 of the Accident Compensation Act 1985;'.

12. Amendment of the Principal Regulations

In the Principal Regulations—

(a)

in regulations 112, 201, 202, 203, 204, 209, 311, 408, 510, 515, 516, 517, 520, 530, 602, 603, 702, 711, 804, 805, 807, 810, 815, 817, 821, 904 and 905 for "Director-General"

(wherever occurring) substitute "Authority";
and

(b) regulation 113 is revoked; and

(c) in regulation 206—

(i) for "Director-General" (where first
occurring) substitute "Authority"; and
