Dangerous Goods (Explosives) Amendment Regulations 2023
The Lieutenant-Governor, having assumed the administration of the government of the State under section 6B of the Constitution Act 1975, with the advice of the Executive Council, makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Dangerous Goods (Explosives) Regulations 2022 to convert fees expressed in dollar amounts to fee units.
2Authorising provision
These Regulations are made under section 52 of the Dangerous Goods Act 1985.
3Commencement
These Regulations come into operation on 5 July 2023.
4Principal Regulations
In these Regulations, the Dangerous Goods (Explosives) Regulations 2022[1] are called the Principal Regulations.
5Issue of a duplicate licence
In regulation 222 of the Principal Regulations, for "$50" substitute "3·27 fee units".
6Issue of a transfer of a licence
In regulation 223 of the Principal Regulations, for "$50" substitute "3·27 fee units".
7Fees for multiple authorisations on a single licence
For the example at the foot of regulation 227 of the Principal Regulations substitute—
"Example
Assuming the fee for a licence authorising storage of explosives is $500 and a licence authorising sale is $62.50. If both licences are sought, the total fee is $521.88, being $500 for the licence authorising storage plus 35% of the fee for a licence authorising sale ($62.50).".
8Manufacture of explosives
(1)In regulation 228(1) of the Principal Regulations, for "$5000" substitute "327·01 fee units".
(2)In regulation 228(3) of the Principal Regulations, for "$312.50" substitute "20·44 fee units".
9Storage of explosives
(1)In regulation 229(1) of the Principal Regulations, for "$250" substitute "16·35 fee units".

10Sale and import of explosives

(2)In the note at the foot of regulation 230 of the Principal Regulations, for "The fee would be calculated as $62.50 plus (35% of $62.50) being $84.38." substitute "Assuming the fee for a licence authorising a person to import or sell explosives is $62.50, the fee to both import and sell explosives would be calculated as $62.50 plus 35% of $62.50, totalling $84.38.".

Fee Units
These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.
The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.
The value of a fee unit for the financial year commencing 1 July 2023 is $15.90. The amount of the calculated fee may be rounded to the nearest 10 cents.
The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
