Dangerous Goods Amendment

(Matches) Regulation 1997

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Dangerous Goods Act 1975.

Explanatory note
The object of this Regulation is to amend the Dangerous Goods Regulation 1978 so as to omit the matter relating to matches from the list of articles prescribed as dangerous goods for the purposes of the Dangerous Goods Act 1975. As a result, all of the types of matches set out in the list in section 9 of the Australian Code for the Transport of Dangerous Goods by Road and Rail (prepared by the Federal Ofice of Road Safety) will be prescribed as dangerous goods (see clause 16 (a1) of the Regulation).

Dangerous goods are subject to the obligations set out in Part 3 of the Dangerous Goods Act 1975 regarding the keeping, conveyance, sale and use of those goods. However, the Dangerous Goods Regulation 1978 exempts people who keep or convey matches from some of those obligations. Clause 145 of the Dangerous Goods Regulation 1978 exempts a person who keeps any quantity of goods of a certain kind, including any matches, from the obligation to licence the premises in or on which the goods are kept. Clause 175 of the Regulation has the effect that a person is not required to obtain a licence to convey matches, unless the matches are conveyed in bulk and in certain vehicles.

This Regulation is made under the Dangerous Goods Act 1975, including the definition of dangerous goods in section 4 and section 41 (the general regulation-making power).
