I, General The Honourable David Hurley AC DSC (Ret’d), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 27 of the Dams Safety Act 1978, make the following Proclamation.

1      Name of Proclamation

This Proclamation is the Dams Safety Amendment (Prescribed Dams) Proclamation
2015.

2      Commencement

This Proclamation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Dams Safety Act 1978 No 96

(1) Schedule 1 Prescribed dams

Insert the following in alphabetical order of names of dams in Columns 1 and 2, respectively:

Bengalla CW1	Dry Creek, Bengalla, near Muswellbrook
Bengalla DW1	Bengalla, near Muswellbrook
Bowra	Bowra Creek, Bowraville
Cumnock Tailings Storage Facility No 3	Near Bayswater Creek, Ravensworth
Montrose	Wambo Creek, Warkworth via Singleton
Pymble Golf Course	Unnamed tributary of Cowan Creek, St Ives
Springvale Reject Emplacement Area	Unnamed tributary of Wangcol Creek, Lidsdale

(2)	Schedule 1
Omit the names of the following dams and the matter relating to them:

Lake Pambulong Detention Basin
Nambucca Off-stream Storage
Newstan Contingency Tailings
Wilpinjong TD1 East
Wilpinjong TD1 West

Explanatory note

The objects of this Proclamation are:

(a)	to add the names and locations of certain dams to the list of prescribed dams in Schedule 1 to the Dams Safety Act 1978 to enable the Dams Safety Committee to exercise certain functions in relation to the dams (including issuing notices requiring things to be done to ensure the safety of the dams), and
(b)	to omit the names and locations of certain other dams from the list of prescribed dams, so as to remove the prescribed status of those dams.
