DAMPIER PORT AUTHORITY AMENDMENT REGULATIONS (No. 2) 1997

Made by the Dampier Port Authority with the approval of the Governor in Executive Council.

Citation

1.These regulations may be cited as the Dampier Port Authority Amendment Regula-

tions (No. 2) 1997.
Principal regulations

2.In these regulations the Dampier Port Authority Regulations 1989* are referred to as

the principal regulations.

Regulation 74 amended

3.Regulation 74 of the principal regulations is amended by deleting "Wharfage" and

substituting the following —
" Subject to regulation 76A, wharfage ".

Regulation 75 amended

(a) the Port Authority property is managed and operated by a person ("the private operator") under an agreement entered into with the Port Au-
thority; and

4.Regulation 75 of the principal regulations is amended by deleting "Service" and sub-

stituting the following —
" Subject to regulation 76A, service ".
Regulation 76 amended

5.Regulation 76 (2) of the principal regulations is amended by deleting 'If and substi-

tuting the following —
" Subject to regulation 76A, if ".
Part 6, Division 5A, inserted

6.After Division 5 of Part 6 of the principal regulations the following Division is in-

serted —

Division 5A — Certain charges not payable if Port Authority property is privately

managed and operated

Certain charges not payable if Port Authority property is privately
managed and operated
76A. The charges referred to in regulations 74, 75 and 76 (2) (as set out in items
2, 3 (a) and (aa) and 4 of Schedule 4) that are payable in respect of Port Authority
property are not payable if —

the agreement provides for charges relating to the matters referred to in those regulations to be imposed by and paid to the private operator.

Passed by a resolution of the Dampier Port Authority at a meeting of the Authority held on
25 November 1997.

The common seal of the Dampier Port Authority was at the time of the abovementioned resolution affixed in the presence of—
