1Citation [see Note 1]

 These regulations may be cited as the Dairy Produce Levy Regulations.

2Interpretation

 In these regulations, unless the contrary intention appears:

Australian Animal Health Council levy means the Australian Animal Health Council levy imposed under paragraph 5 (1) (g) of the Act.

Corporation levy means the Corporation levy imposed under paragraph 5 (1) (d) of the Act.

 manufacturing milk levy means the manufacturing milk levy imposed under paragraph 5 (1) (b) of the Act.

market milk levy means the market milk levy imposed under paragraph 5 (1) (a) of the Act.

 promotion levy means the promotion levy imposed under paragraph 5 (1) (e) of the Act.

research levymeans the research levy imposed under paragraph 5 (1) (f) of the Act.

 the Act means the Dairy Produce Levy (No. 1) Act 1986.

3Prescribed varieties of cheese — definition of dairy product in subsection 4 (1) of the Act

 For the purposes of paragraph (c) of the definition of dairy product in subsection 4 (1) of the Act, each variety of cheese specified in Schedule 1 is prescribed.

4Market milk levy — prescribed milk fat rate and protein rate

  • (1)

    For the purposes of paragraph 6 (a) of the Act, the milk fat rate prescribed in relation to the market milk levy is 15.750 cents per kilogram.

  • (2)

    For the purposes of paragraph 6 (b) of the Act, the protein rate prescribed in relation to the market milk levy is 38.3906 cents per kilogram.

4AManufacturing milk levy — prescribed milk fat rate and protein rate

  • (1)

    For the purposes of the definition of milk fat rate in subsection 7 (1) of the Act, the milk fat rate prescribed in relation to the manufacturing milk levy is 31.070 cents per kilogram.

  • (2)

    For the purposes of the definition of protein rate in subsection 7 (1) of the Act, the protein rate prescribed in relation to the manufacturing milk levy is 74.007 cents cents per kilogram.

4BOther levies — prescribed milk fat rate and protein rate

  • (1)

    For paragraph 9 (1) (a) of the Act, the following milk fat rates are prescribed:

    • (a)

      in relation to Corporation levy — 0.1400 cents a kilogram;

    • (b)

      in relation to promotion levy — 1.4525 cents a kilogram;

    • (c)

      in relation to research levy — 1.015 cents a kilogram;

    • (d)

      in relation to Australian Animal Health Council levy — 0.0223 cents a kilogram.

  • (2)

    For paragraph 9 (1) (b) of the Act, the following protein rates are prescribed:

    • (a)

      in relation to Corporation levy — 0.3413 cents a kilogram;

    • (b)

      in relation to promotion levy — 3.5405 cents a kilogram;

    • (c)

      in relation to research levy — 2.474 cents a kilogram;
