Dairy Produce Levy Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting under section 4 of the Acts Interpretation Act 1901, and with the advice of the Federal Executive Council and having taken into consideration:

  • (a)

    a report made to the Minister by the executive of the Australian Dairy Industry Council Inc. relating to the rate to be prescribed for the purposes of sections 6 and 9 of the Dairy Produce Levy (No. 1) Act 1986; and

  • (b)

    a report made to the Minister by the Executive Director of the Australian Bureau of Agricultural and Resource Economics relating to the rate to be prescribed for the purposes of subsection 7 (1) of that Act;

make the following Regulations under that Act.

1.   Commencement

1.1   These Regulations commence on 1 July 1995.

2.   Amendment

2.1   The Dairy Produce Levy Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   Insert the following definitions:

“ ‘Corporation levy’ means the Corporation levy imposed under paragraph 5 (1) (d) of the Act;

manufacturing milk levy’ means the manufacturing milk levy imposed under paragraph 5 (1) (b) of the Act;

market milk levy’ means the market milk levy imposed under paragraph 5 (1) (a) of the Act;

promotion levy’ means the promotion levy imposed under paragraph 5 (1) (e) of the Act;

research levy’ means the research levy imposed under paragraph 5 (1) (f) of the Act;”.

4.   Regulation 4 (Rates of levy on the milk fat content of relevant dairy produce)

4.1   Omit the regulation, substitute:

Market milk levy—prescribed milk fat rate and protein rate

“4.

(1) For the purposes of paragraph 6 (a) of the Act, the milk fat rate prescribed in relation to the market milk levy is 15.750 cents per kilogram.

“(2)

For the purposes of paragraph 6 (b) of the Act, the protein rate prescribed in relation to the market milk levy is 38.3906 cents per kilogram.

Manufacturing milk levy—prescribed milk fat rate and protein rate

“4A.

(1) For the purposes of the definition of ‘milk fat rate’ in subsection 7 (1) of the Act, the milk fat rate prescribed in relation to the manufacturing milk levy is 33.271 cents per kilogram.

“(2)

For the purposes of the definition of ‘protein rate’ in subsection 7 (1) of the Act, the protein rate prescribed in relation to the manufacturing milk levy is 79.851 cents per kilogram.

Other levies—prescribed milk fate rate and protein rate

“4B.

(1) For the purposes of paragraph 9 (a) of the Act, the following milk fat rates are prescribed:

  • (a)

    in relation to the Corporation levy—0.1400 cents per kilogram;

  • (b)

    in relation to the promotion levy—1.8025 cents per kilogram;

  • (c)

    in relation to the research levy—0.6300 cents per kilogram.

“(2)

For the purposes of paragraph 9 (b) of the Act, the following protein rates are prescribed:

  • (a)

    in relation to the Corporation levy—0.3413 cents per kilogram;

  • (b)

    in relation to the promotion levy—4.3936 cents per kilogram;

  • (c)

    in relation to the research levy—1.5356 cents per kilogram.”.

5.   Regulation 5 (Prescribed minimum percentage—subsection 9 (4) of the Act)

5.1   Omit the regulation.

6.   Regulation 5A (Minimum weight—subsection 9 (4) of the Act)

6.1   Omit the regulation.

7.   Regulation 6 (Rates of levy on dairy products)

7.1   Omit the regulation.

8.   Schedule 2 (Rates of Levy)

8.1   Omit the Schedule.
