REGULATIONS UNDER THE DAIRY PRODUCE EXPORT

CONTROL ACT 1924-1947.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Dairy Produce, Export Control Act 1924-1947.

Amendments of the Dairy Produce Export Control (Staff) Regulations. 

1. Regulation 3 of the Dairy Produce Export Control (Staff) Regulations is repealed and the following regulation inserted in its stead:—

Definitions.

“3. In these Regulations, unless the contrary intention appears—

‘officer’ means an officer appointed under section 13 of the Act;

‘the Act’ means the Dairy Produce Export Control Act 1924-1947;

‘the Secretary’ means the Secretary to the Board, and includes an officer for the time being acting as the Secretary.”.

2.—(1.) Regulation 5 of the Dairy Produce Export Control (Staff) Regulations is repealed and the following regulation is inserted in its stead:—

Salaries of officers.

“5.—(1.) An officer who occupies an office specified in column 1 of the table in this sub-regulation is entitled to the annual salary, or

salary within the limits of salary, specified in column 2 of that table opposite to that office and to the increments of salary within those limits specified in column 3 of that table.

“(2.) An officer is not entitled to an increment of salary until he has received salary without the increment for not less than twelve months.

“(3.) The salary to which an officer is entitled under this regulation shall, from time to time, be subject to variation in accordance with the provisions of regulation 106a of the Public Service Regulations as inserted by Statutory Rules 1951, No. 77.”.

(2.) This regulation shall be deemed to have come into operation on the thirtieth day of June, 1951.

Repeal of Regulation 5aa.

3.— (1.) Regulation 5aa of the Dairy Produce Export Control (Staff) Regulations is repealed.

(2.) This regulation shall be deemed to have come into operation on the thirtieth day of June, 1951.

4.—(1.) Regulation 5b of the Diary Produce Export Control (Staff) Regulations is repealed and the following regulation inserted in its stead:—

Conditions of employment of officers.

“5b.—(1.) Subject to these Regulations, officers shall be employed under the same conditions with respect to leave of absence and holidays as those prescribed in relation to officers of the Commonwealth Public Service by the Commonwealth Public Service Act 1922-1948, or by that Act as amended, and under the same conditions with respect to attendance, performance of duties, hours of duty and overtime payment, and travelling and other allowances as those prescribed in relation to officers of the Commonwealth Public Service by the Commonwealth Public Service Regulations.

“(2.) Where the Board certifies that the functions and duties of an officer, or officers included in a class of officers, employed by the Board are substantially similar to those of an officer, or officers included in a class of officers, in relation to whom a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, specified in the certificate makes provision with respect to a matter specified in the last preceding sub-regulation, that officer, or the officers included in that class of officers, employed by the Board shall be employed under the same conditions with respect to that matter as are prescribed by the determination.

“(3.) Where a condition of employment prescribed by sub-regulation (1.) of this regulation is inconsistent with a condition of employment prescribed by sub-regulation (2.) of this regulation, the latter shall prevail and the former shall, to the extent of the inconsistency, not apply to, or in relation to, officers.

“(4.) For the purposes of this regulation, a reference in the Commonwealth Public Service Act 1922-1948, or in that Act as amended, the Commonwealth Public Service Regulations or a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, to the Public Service Board, the Permanent Head or the Chief Officer shall be read as a reference to the Chairman of the Australian Dairy Produce Board.”.

(2.) This regulation shall be deemed to have come into operation on the twenty-ninth day of December, 1949.

Repeal of regulations 6–13, inclusive.

5.—(1.) Regulations 6 to 13, inclusive, of the Dairy Produce Export Control (Staff) Regulations are repealed.

(2.) This regulation shall be deemed to have come into operation on the twenty-ninth day of December, 1949.

6.—(1.) Regulation 15 of the Dairy Produce Export Control (Staff) Regulations is repealed and the following regulation inserted in its stead:—

Officers engaged in the United Kingdom.

“15.—(1.) Officers appointed and employed in the United Kingdom shall be paid at the rates, and employed under the conditions, prescribed by the High Commissioner (Staff) Regulations.

“(2.) For the purposes of this regulation, any powers, duties and functions which, under the High Commissioner (Staff) Regulations, are exercisable by the High Commissioner or the Official Secretary shall be exercisable by the representative of the Board in London appointed under section 12 of the Act.”.

(2.) This regulation shall be deemed to have come into operation on the thirtieth day of June, 1951.

Repeal of Schedule.

7.—(1.) The Schedule to the Dairy Produce Export Control (Staff) Regulations is repealed.

(2.) This regulation shall be deemed to have come into operation on the thirtieth day of June, 1951.

Salaries during certain periods.

8.—(1.) Notwithstanding the provisions of the Dairy Produce Export Control (Staff) Regulations as in force during the period which commenced on the eleventh day of March, 1949, and ended on the twenty-ninth day of June, 1951, an officer of the Board to whom this regulation applies shall be deemed to have been entitled to annual salary in respect of his service during that period in accordance with this regulation.

(2.) An officer of the Board who occupied an office specified in column 1 of Table A in the Schedule to these Regulations during the period which commenced on the eleventh day of March, 1949, and ended on the twenty-eighth day of December, 1949, shall, in respect of his service during that period, be deemed to have been entitled to the annual salary, or salary within the limits of salary, specified in column 2 of that Table opposite to that office and to the increments of salary within those limits specified in column 3 of that Table.

(3.) An officer of the Board who occupied the office of Publicity Officer shall be deemed to have been entitled to annual salary within the limits of—

(a) £614-£662 in respect of his service in that office during the period which commenced on the fourteenth day of March, 1949, and ended on the twenty-ninth day of June, 1949; and

(b) £654-£702 in respect of his service in that office during the period which commenced on the thirtieth day of June, 1949, and ended on the twenty-eighth day of December, 1949.

(4.) An officer of the Board who occupied an office specified in column 1 of Table B in the Schedule to these Regulations shall, in respect of his service during the period which commenced on the twenty-ninth day of December, 1949, and ended on the twenty-ninth day of June, 1951, be deemed to have been entitled to the annual salary,

or salary within the limits of salary, specified in column 2 of that Table opposite to that office and to the increments of salary within those limits specified in column 3 of that Table.

(5.) The salary to which an officer of the Board is deemed to have been entitled under this regulation during a period specified in the last three preceding sub-regulations shall, from time to time, be deemed to have been subject to variation in accordance with the provisions of regulation 106a of the Commonwealth Public Service Regulations as in force during that period.
