140 DAIRY PRODUCE. Dairy Produce Acts Amendment Act. 1 E liz . II. No. 6, DAIRY PRODUCE. 1J£YIL An Act to Amend “The Dairy Produce Acts, 1920 to 1944,” in certain particulars. A mendment act of 1952. [A ssented to 17 th A pril , 1952.] E it enacted by the Queen’s Most Excellent Majesty, B by and with the advice and consent of the Legis­ lative Assembly of Queensland in Parliament assembled, and by the authority of the same as follows:— Short title 1. This Act may be cited as The Dairy Produce obstruction. Acts Amendment Act of 1952,” and shall be read as one ' with *“ The Dairy Produce Acts , 1920 to 1944,” herein referred to as the Principal Act. Collective The Principal Act and this Act may be cited title. collectively as The Dairy Produce Acts, 1920 to 1952.” Ammirimentg 2. Section three of the Principal Act is amended— ofs-3- (i.) By repealing the definition of the term “ Chief Inspector of Stock ” in that section ; (ii.) By repealing the definition of the term “Depot” in that section and by inserting, in lieu of that repealed definition, the following definition, namely:— Depto- “ “ Depot ”—Any building, structure, or other place where milk or cream is deposited for the purpose of weighing, measuring, sampling, testing, or grading pending consignment or reconsignment to any other dairy produce premises, or where milk or cream is held for distribution for or upon sale by wholesale or is subjected to any treatment other than pasteurisation; ” ; (iii.) By repealing in the definition of the term “ Factory ” in that section the words “ place where milk or cream is held for distribution by wholesale or is treated or pasteurised ” and by inserting, in lieu of those repealed words, the words “ other place where milk or cream is subjected to pasteurisation ” ; * 10 G. 5 No. 15 and amending Acts.

By inserting after the definition of the term “ Package ” in that section the following definition, namely :— j “ “ Pasteurisation ”—The efficient treatment by Pasteurisa- , heating and cooling carried out in ac cordancetion* with the prescribed method or methods and by the use of approved equipment of milk, cream, or other dairy produce; ” ; (v.) By repealing the definition of the term “ Veterinary officer ” in that section ; (vi.) By adding to that section the following paragraph, namely :— “ Any reference in this Act to any other Act shall be deemed to include a reference to any later Act amending or in substitution for that other Act.” 3. Subsection two of section eight of the Principal Amendment Act is repealed and the following subsection is inserted of s- 8­ in lieu of that repealed subsection, namely:— (2.) An inspector may deliver or cause to be delivered any sample of dairy produce ingredient material or water to an expert for examination or to an analyst for analysis and the expert or analyst shall, upon receipt of the sample, with all convenient speed examine or, as the case may be, analyse the same and give a certificate of the result of the examination or analysis in the prescribed form or in that form varied to adapt the same to circumstances.” 4. Section 11 a of the Principal Act is repealed Repeal of and the following section is inserted in lieu of that ^a^ew repealed section, namely' [11 a .] (1.) Every owner of a dairy where a steam milking machine is installed shall install, maintain, and water use either an approved steam steriliser or an approved boilers in water boiler of a prescribed type for the purpose of*19™68, cleansing and sterilising that milking machine jand any other apparatus or any utensil used, or any work requiring cleansing and sterilising done, in that dairy. (2.) No person shall install or use in any dairy any steam steriliser which is not approved, or any water boiler which is not of a type prescribed for the purposes of this section or being of such a type is not approved.”
142 DAIRY PRODUCE. Dairy Produce Acts Amendment Act. 1 E liz . II. No. 6, Amendments of s. 16. 5 . Section sixteen of the Principal Act is amended— (i.) By inserting after subparagraph ( 6 ) of subsection one of that section the following subparagraphs, namely:— “or (c) On the basis of the number of gallons supplied ; or (d) On the basis of the weight supplied; or (e) On such other basis as may be prescribed : ” (ii.) By inserting after subparagraph ( 6 ) of subsection two of that section the following subparagraphs, namely or (c) On the basis of the number of gallons supplied; or (d) On the basis of the weight supplied; or (e) On such other basis as may be prescribed.” Amendment 6. In subparagraph (vi.) of subsection eight of of s. 16 b (8). gec^ion 16 b of the Principal Act the words “ cream routes or ” are inserted after the words “ The varying or cancellation of existing ' Amendment 7. In subparagraph (v.) of subsection eight of of s. i6c (8). section 16c of the Principal Act the words “ milk routes or ” are inserted after the words “ The varying or cancellation of existing sal of 8 . Section 16 e of the Principal Act is repealed s a . nd 16 n e e . w and the following section is inserted in lieu of that repealed section, namely :— Canvassing “ [16 e .] Any person who by canvassing, touting, oream!,k and speaking, writing, or by any advertisement, pamphlet, or means whatsoever of producing or transmitting light or sound, or other means whatsoever does or causes to be done anything calculated or intended to induce any producer or owner— (a) To divert his supply or portion of his supply of - milk from one cheese factory to another cheese factory; or (b) To divert his supply or portion of his supply of cream from one butter factory to another butter factory ; or

(c) To cease his supply or portion of his supply of milk to a cheese factory for the purpose of diverting the cream obtainable from same to a butter factory ; or (d) To cease his supply or portion of his supply of cream to a butter factory for the purpose of diverting the milk from which same is obtained to a cheese factory, shall be guilty 6 f an offence and shall be liable to a penalty of not more than twenty pounds.” 9. Section 20 b of the Principal Act is amended— Amendments (i.) By inserting in subsection one of that section °f 8' 20b' the words “ or depot ” after the word “ factory ” wherever that word occurs. (ii.) By repealing in subsection two of that section the words “ of a cream separator capable of separating not more than twenty gallons of milk per hour, nor shall the said subsection one prohibit the keeping or depositing at a cheese factory ” and by inserting, in lieu of those repealed words, the words “, an ice-cream factory, or a factory at which milk or separated milk is dried, concentrated, or condensed of a cream separator, but only if that cream separator is installed in such a position as the Minister directs; nor shall the said subsection one prohibit the keeping or depositing at any factory as aforesaid ”. 10. In section thirty-one of the Principal Act the Amendments words “veterinary officer or authorised person ” whereverofs’ 3L appearing therein are repealed. 11. Section thirty-six of the Principal Act is Repeal of repealed. s-36- 12. The Second Schedule to the Principal Act is Amendment* amended— ofSch. n. (i.) By adding to clause twenty-four of that Schedule the words “ including, but without limit to the generality thereof, the prescribing of a method or of methods in accordance with which all or any of those things shall be carried out ” ; (ii.) By repealing in clause forty-four of that Schedule the words “ Any other matters ” and by inserting, in lieu of those repealed words, the words “ Prescribing all matters or things which by this Act are required or permitted to be prescribed and any other matters”.
