607 ANNO VICESIMO OCTAVO ELIZABETHAE SECUNDAE REGINAE No. 61 of 1979 An Act to amend the Dairy Produce Act 1978 in certain particulars [ASSENTED TO 18TH DECEMBER, 1979] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Dairy Produce Act Amendment Act 1979. (2) The Dairy Produce Act 1978 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Dairy Produce Act1978-1979. 2. Commencement . This Act shall commence on a date appointed by Proclamation.

Section 16 of the Principal Act is amended by- (a) in subsection (2), in paragraph (a), adding at the end of subparagraph (v) the words " , if any "; (b) in subsection (3), in paragraph (d), inserting after the word " prescribed " where firstly occurring the words " either generally or in a particular case ". 4. Amendment of s. 21. Section 21 of the Principal Act is amended by inserting after subsection (4) the following subsection:- " (5) Notwithstanding this section, the Director may, in a case where an application for a certificate of competency is made in accordance with the regulations, by a permit in writing, authorize the applicant, pending the determination of the application, to do such of the acts and things that he would be authorized to do if the certificate in respect of which the application is made were granted as the Director determines.". 5. Amendment of s. 22. Section 22 of the Principal Act is amended by inserting after the word " competency " where it occurs in the first paragraph the words " or permit ". 6. Amendment of s. 23. Section 23 of the Principal Act is amended by- it or ( tha)e ihnoslduebrseocftaiopne( r1m)i,tipnusersrutianngt atofteserctthioenw2o1rd( 5") uonfd"e;r " the words (b) in subsection (2), inserting after the word " tester " the words " or as a grader or tester under the authority of a permit. pursuant to section 21 (5) " ; (c) in subsection (3), inserting after the figures " 21 (1) " the words " or the permit prescribed by section 21 (5) "; (d) in subsection (4), inserting after the word " competency " the words " or permit ". 7. Amendment of s. 57. Section 57 of the Principal Act is amended by, in subsection (4), inserting after paragraph (c) the following paragraph:- 66 . (d) may provide for the approval of the Under Secretary, Director or an inspector to be the standard to be.applicable in respect of a particular matter ". 8. Amendment of Third Schedule. The Third Schedule to the Principal Act is amended by- (a) in clause 12, inserting at the end thereof the words " ; prescription of standards for buildings, structures and dairy produce premises "; (b) in clause 20, omitting the words " The regulation " and substituting the words " Prescription of standards for and the regulation ";

Dairy Produce Act Amendment Act 1979, No. 61 609 (c) omitting clause 35 and substituting the following clause:- " 35. Fees, charges and the like . Fees, charges, allowances, costs and expenses payable or to be paid under this Act and the fixing thereof; matters and things in respect of which they are payable or to be paid; methods of collection thereof; manner, time and place of payment thereof; persons by whom and to whom they are payable; all matters with respect to the recovery thereof.".
