Dairy Industry Stabilization Regulations (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Dairy Industry Stabilization Act 1977.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Dairy Industry Stabilization Regulations.2

Interpretation

2. Regulation 2 of the Principal Regulations is amended by omitting the definitions of “Director of Finance” and “Financial Controller” and substituting the following definitions:

“ ‘Director, Financial Management’ means the person for the time being occupying, or performing the duties of, the office of Director, Financial Management in the Department of Primary Industry;

‘Manager, Finance Division’ means the person for the time being employed by the Corporation as Manager, Finance Division and includes a person for the time being acting as Manager, Finance Division;”.

Repeal of Regulation 3

3. Regulation 3 of the Principal Regulations is repealed.

Account to which moneys in respect of certain dairy products are to be credited

4. Regulation 4 of the Principal Regulations is amended by adding at the end thereof the following sub-regulations:

“(2) Any moneys credited to the fund under sub-section 10 (1) of the Act that were paid by the Commonwealth to the Corporation by reason of the receipt by the Commonwealth, from time to time, of levy in respect of processed butteroil are to be credited to the account in respect of butter and butteroil produced during the production period (being a production period with respect to butter and butteroil) during which the product in respect of which the levy was received by the Commonwealth was produced.

“(3) Any moneys credited to the fund under sub-section 10 (1) of the Act that were paid by the Commonwealth to the Corporation by reason of the receipt by the Commonwealth, from time to time, of levy in respect of processed cheese are to be credited to the account in respect of cheese produced during the production period (being a production period with respect to cheese) during which the product in respect of which the levy was received by the Commonwealth was produced.”.

5. The Principal Regulations are further amended as set out in the Schedule.
