Act N o . 4 3 , 1979 .

An Act to amend the Dairy Industry Authority Act, 1970, with respect to the age of members of the Dairy Industry Authority of New South Wales; to provide further for the making of certain payments by that Authority; and in certain other respects. I[Assented to, 9th May, 1979.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows : —

1. This Act may be cited as the "Dairy Industry Authority

(Amendment) Act, 1979".

2. The Dairy Industry Authority Act, 1970, is amended—

(a) by inserting in the definition of "treatment" in section 4 (1) after the word "pasteurisation," the words "processing by means of an ultra heat treatment method,";

(b) (i) by omitting from section 8 (8) the word "sixty-

five" and by inserting instead the matter "70";

(ii)    by omitting from section 8 (13) (h) the word "sixty-five" and by inserting instead the matter "70";

(c)	by omitting section 18B (1 ) and by inserting instead the following subsection :—
(1) Where the Authority cancels or reduces a quota allocated by the Authority to a person in relation to the delivery to and acceptance of milk by the Authority,
the Authority may, with the approval of the Minister (as to the giving or refusal of which he has an absolute

discretion) pay, from the funds of the Authority, to the person who, in the opinion of the Authority, is the holder of the quota, such amount as, subject to subsection ( 2 ) , the Minister specifies when giving his approval.

(d) (i) by inserting in section 35 (1) (a) after the word "pasteurised" the words ", processed by means of an ultra heat treatment method";

(ii)   by inserting in section 35 (1A) after the word "pasteurised" the words ", processed by means of an ultra heat treatment method";

(iii)   by inserting in section 35 (1A) after the word "pasteurising" the words ", processing by means of an ultra heat treatment method".
