Dairy Industry Amendment Act (No. 2) 2000

An Act to amend the Dairy Industry Act 1994

[Royal Assent 13 December 2000]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Dairy Industry Amendment Act (No. 2) 2000 . 2CommencementThis Act commences on a day to be proclaimed. 3Principal ActIn this Act, the Dairy Industry Act 1994 is referred to as the Principal Act. 4Section 22 amended (Issue of licences) Section 22 of the Principal Act is amended by inserting "and on payment of the prescribed fee or on the Authority entering into an arrangement under section 22B " after "a licence". 5Sections 22A and 22B insertedAfter section 22 of the Principal Act , the following sections are inserted in Part 3: 22AWaiver and refund (1)  The Authority may waive the payment of the whole or any part of the prescribed fee under section 22 or 25 in any circumstances it considers appropriate. (2)  The Authority may refund the whole or any part of the prescribed fee under section 22 or 25 in any circumstances it considers appropriate. 22BArrangements for collection of fees The Authority may enter into any arrangement with any person for the collection of the prescribed fee under section 22 or 25 and the payment of those fees to the Authority. 6Section 25 amended (Renewal of licences) Section 25(3)(a) of the Principal Act is amended by inserting ", on payment of the prescribed fee or on the Authority entering into an arrangement under section 22B " after "conditions". 7Section 52 amended (Regulations) Section 52 of the Principal Act is amended by inserting after subsection (4) the following subsection: (5)  Regulations may provide for the – (a) payment of any prescribed fee by instalments; and (b) reduction of any prescribed fee in any circumstances the Authority considers appropriate.
