AN ACT to amend the Dairy Industry Act

1973-1981.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Dairy and citation.

Commence-

ment. 2. This Act shall come into operation on a day

to be fixed by proclamation.

Section 30

amended. 3. Section 30 of the principal Act is amended

by inserting after subsection (6) the following

subsection

(6a) Where

(a)	an application is made to the Authority under subsection (4) (a) of this section, after the commence- ment of the Dairy Industry Amendment Act 1982 and before 31 December 1983, for the transfer of a quota, or such an application has been made before such commence- ment but has not been determined by the Authority; and
(b)	the Authority considers that the application should be refused on any ground but that the directions for the time being furnished to it by the Minister under this section do not require it to refuse the application on that ground,

the following provisions shall apply, notwith- standing any other provision of this section

(c)	the Authority shall refer the application to the Minister for decision;
(d)	the Minister shall either refuse or approve the application, and shall remit the application to the Authority to advise the applicant in writing of his decision;
(e)	the Minister shall not be required to give any reason for a refusal to approve an application;

(f)	the decision of the Minister on the application shall be final; and
(g)	subsection (11) of this section shall not apply to a person who transfers a quota with the approval of the Minister granted under this sub- section. " .
