Dairy Industry (Amendment) Act 1960 (NSW)
DAIRY INDUSTRY ( A M E N D M E N T ) ACT.
A c t No . 4 2 , 1 9 6 0 .
An Act to provide for the labelling of margarine; for this purpose to amend the Dairy Industry Act, 1915-1955; and for purposes connected therewith. [Assented to, 4th November, 1960.]
| BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative | Council and Legislative Assembly of New South Wales in |
| Parliament assembled, and by the authority of the same, as follows: — | |
| 1. (1) This Act may be cited as the "Dairy Industry (Amendment) Act, 1960". | |
| (2) The Dairy Industry Act, 1915, as amended by subsequent Acts and by this Act, may be cited as the Dairy Industry Act, 1915-1960. | |
| (3) This Act shall commence upon a day to be appointed by the Governor and notified by proclamation | |

2. The Dairy Industry Act, 1915-1955, is amended—
(a) (i) by inserting in subsection one of section two next after the definition of "Minister" the following new definition : —
"Package" includes anything in or by which goods are cased, covered, enclosed, con tained or packed, and "packed" has a corresponding interpretation.
(ii) by inserting in the same subsection next after the definition of "Table margarine license" the following new definition : —
"Writing." Expressions referring to writing include printing, stencilling, typing, and any mode of representing or reproducing words or figures in a visible form.
| (b) | by inserting next after section twenty-one the following new section : — |
21A. (1) No person shall sell (otherwise than for export beyond the Commonwealth of Australia) any margarine, unless such margarine is packed in a package on which is written—
(a)
the name and address of the manufacturer of the margarine; and
(b) (i) in the case of table margarine, not being
margarine manufactured pursuant to section 22B of this Act, the words "table margarine"; or (ii) in the case of cooking margarine and any margarine manufactured pursuant to section 22B of this Act, the words "cooking margarine".
(2) Any person who fails to comply with any of the provisions of this section shall be liable upon summary conviction to a penalty not exceeding one hundred pounds.

by inserting next after subsection one of section twenty-five the following new subsection : —
(1A) Without limiting the generality of sub section one of this section the Governor may make regulations for and with respect to : —
(a)
the size, description and position of the writing on packages of each class of marga rine mentioned in section 21A of this Act, of the particulars required to be written on such packages by that section; or
(b)
prohibiting the use of any other writing or any matter on packages of margarine or regulating the size, description, position and wording of any other writing or any matter on packages of margarine.
