Dairy Industry Amendment

Regulation 1996

Dairy Industry Act 1979

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Dairy Industry Act 1979.

Explanatory note

The objects of this Regulation are:

(a)	to allow for an amount to be deducted (as determined by the New South Wales Dairy Corporation) from the margin for a dairy farmer in relation to the presence of Enzootic Bovine Leucosis in any milk delivered by the dairy farmer to the Corporation on or after 1 July 1999, and
(b)	to remove the requirement for the reduction of industry margins in relation to payments to the Distribution Sector Rationalisation Scheme as all payments have now been made.

This Regulation is made under the Dairy Industry Act 1979, including sections 56 (Fixing of milk prices), 103 (the general regulation making power in particular section 103 (1) (w)) and section 35E (4).

1 Name of Regulation

This Regulation is the Dairy Industry Amendment Regulation

1996.

2 Commencement

This Regulation commences on 16th December, 1996.

3 Amendment of Dairy Industry Regulation 1995

The Dairy Industry Regulaton 1995 is amended as set out in

Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 3)

[1]     Clause 33 Adjustment to sector prices determined under clause 31 (2)

Insert at the end of clause 33 (1) (c):

and,

(d) there must be deducted from the sector price such amount, as may be determined by the Corporation, in respect of the presence of Enzootic Bovine Leucosis in any milk delivered or caused to be delivered by a dairy farmer and accepted by the Corporation on or after 1 July 1999.
