His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Dairy Industry Act 1979.

Explanatory note

The Dairy Industry Regulation 1995 authorises certain amounts to be deducted from the price paid to dairy farmers for milk to enable the funding of the Fresh NSW Schools Milk Program.

The object of this Regulation is to enable those amounts to be paid instead into a Farm Gate Deregulation Assistance Fund to be established by the Dairy Corporation.

The Regulation also updates references to the New South Wales Dairy Corporation to Safe Food New South Wales, and repeals out of date provisions, as a consequence of the enactment of the Food Production (Safety) Act 1998.

This Regulation is made under the Dairy Industry Act 1979, including section 56 and section 103.

1     Name of Regulation

This Regulation is the Dairy Industry Amendment (Farm Gate
Deregulation Assistance Fund) Regulation 1999.

2 Amendment of Dairy Industry Regulation 1995

The Dairy Industry Regulation 1995 is amended as set out in

Schedule 1.

Omit “the Corporation” wherever occurring.
Insert instead “Safe Food”.

[2]     Clause 5 Appeals against decisions of Safe Food to cancel, or to refuse applications for, certificates of registration

Omit “, or of section 33 (4) of the Act as read in accordance with section
35 (3) of the Act”.

[3]     Clause 11 Treatment of putrescent cream

Omit the clause.

Amounts paid towards the funding of the Fresh NSW Schools Milk Program in accordance with this clause from 3 September 1999 until the commencement of this subclause are to be transferred to the Farm Gate Deregulation Assistance Fund established by the Corporation.
