GLEESON CJ:   This appeal was heard in Perth on 26 October 2004 by a Court constituted by Justices McHugh, Hayne, Callinan, Heydon and myself.  On 6 April 2005 the Court made orders allowing this appeal.  The Court now orders:  in place of order 2 pronounced on 6 April 2005 order as follows:

2.        Set aside the orders of the Full Court of the Supreme Court of Western Australia made on 9 December 2002;

3.        Remit the matter to the Court of Appeal of the Supreme Court of Western Australia to deal with the outstanding issues of the quantum of damages;

4.        The costs of the appeal to the Full Court be in the discretion of the Court of Appeal.
