GUMMOW J:   This appeal was heard in Canberra on 14 March 1997 by the Chief Justice and Justices Dawson, McHugh, Kirby and myself.  At the conclusion of the hearing the Court ordered that the appeal be allowed and made consequential orders.  The Court announced that reasons for judgment would be published in due course.  I now publish those reasons.

The Chief Justice and Justice Dawson favoured allowing the appeal.  I publish their Honours’ reasons.  Justice McHugh would have dismissed the appeal.  I publish his Honour’s reasons.  I favoured allowing the appeal and I publish my reasons.  Justice Kirby would have dismissed the appeal and I publish his Honour’s reasons.
