An Act to render valid certain Payments made

under the Customs Act of 1865. [20th August,
1866.]
WHEREAS doubts have been entertained whether by the Customs Act of 1865 the additional duties thereby imposed on the goods therein referred to were made chargeable on goods then in bond

and whereas it was intended by the said Act to make all such goods chargeable with the said duties and whereas the said additional duties have been levied and paid upon such goods then in bond and it is expedient and necessary to stay and prevent proceedings against persons concerned in levying and collecting the said duties and to make valid such levying and collecting Be it declared and enacted by the Queen's Most Excellent Majesty by and with the advice and consent

of the Legislative Council and Legislative Assembly of New South

Wales in Parliament assembled and by the authority of the same as follows:—

1. All duties which previous to the passing of this Act may have been collected levied or received as hereinbefore mentioned on goods in bond at the time of the passing of the said recited Act shall

be and be taken to have been as lawfully levied collected and received

as if the same had been expressly imposed by the authority of the said recited Act And no action shall be commenced or further prosecuted against any person concerned in levying collecting and receiving any of the said duties Provided that nothing herein contained shall affect any action in which judgment has been already pronounced.

2. This Act shall be styled and may be cited as the " Customs

Validation Act."
