CUSTOMS TARIFF AMENDMENT ACT 1977

No. 73 of 1977

An Act relating to Duties of Customs.

BE IT ENACTED by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia, as follows:—

Short title, &c.

1. (1) This Act may be cited as the Customs Tariff Amendment Act 1977.

(2) The Customs Tariff Act 1966 is in this Act referred to as the Principal Act.

Commencement.

2. Except as otherwise provided, this Act shall be deemed to have come into operation on 1 February 1977.

Ordinary preferential rates of duty.

3. Section 17 of the Principal Act is amended—

(a) by omitting sub-section (2a) and substituting the following sub-section:—

“(2a) For the purposes of the application of this section to goods that are the produce or manufacture of Papua New Guinea, there shall be deemed to be substituted for the rate of duty specified in column 4 in the tariff classification in Part II of Schedule 1 that applies to the goods—

(a) if an item in Part V of that Schedule applies to the goods—the rate of duty specified in column 4 of that item; or

(b) if no item in that Part applies to the goods—the word ‘Free’.”; and

(b) by inserting in sub-section (2c), after the words “of Schedule 1 “, the words “or an item in Part V of Schedule 1”.

Special preferential rates of duty.

4. Section 17a of the Principal Act is amended—

(a) by omitting sub-section (2) and substituting the following sub-section:—

“(2) Sub-section (1) does not apply in relation to goods to which an item in Part IX of Schedule 5 applies if section 17 also applies to the goods.”; and

(b) by omitting paragraph (f) of sub-section (3).

Substituted rates of duty.

5. Section 17b of the Principal Act is amended—

(a) by inserting in paragraph (a) of sub-section (2), after the words “in Part III”, the words “or Part V”;

(b) by omitting from paragraph (b) of sub-section (2) the words “in that Part” and substituting the words “in Part III or Part V, as the case may be, of that Schedule”; and

(c) by inserting in sub-section (2), after the words “in Part III” (last occurring), the words “or Part V, as the case may be,”.

Amendment having effect from 1 January 1975.

6. (1) The Principal Act is amended as set out in Schedule 1.

(2) This section shall be deemed to have come into operation on 1 January 1975.

Amendments having effect from 22 October 1976.

7. (1) The Principal Act is amended as set out in Schedule 2.

(2) This section shall be deemed to have come into operation on 22 October 1976.

Amendments having effect from 17 November 1976.

8. (1) The Principal Act is amended as set out in Schedule 3.

(2) This section shall be deemed to have come into operation on 17 November 1976.

Amendment having effect from 3 December 1976.

9. (1) The Principal Act is amended as set out in Schedule 4.

(2) This section shall be deemed to have come into operation on 3 December 1976.

Amendments having effect from 15 December 1976.

10. (1) The Principal Act is amended as set out in Schedule 5.

(2) This section shall be deemed to have come into operation on 15 December 1976.

Amendments having effect from 1 January 1977.

11. (1) The Principal Act is amended as set out in Schedule 6.

(2) This section shall be deemed to have come into operation on 1 January 1977.

12. (1) The Principal Act is amended as set out in Schedule 7.

(2) This section shall be deemed to have come into operation on 29 January 1977.

(2) This section shall be deemed to have come into operation on 18 February 1977.
