Customs Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2.   New regulation 31A

2.1   After regulation 31, insert:

Goods exempted under paragraph 68 (1) (i) of the Act

 “31A. For paragraph 68 (1) (i) of the Act, goods mentioned in subregulations 125A (2) to (5) (inclusive) are exempted from section 68.

“[NOTE:  Section 68 deals with the entry requirements for imported goods.]”.

3.   Regulation 125A (Importation of goods on a temporary basis for certain events)

3.1   Omit the regulation, substitute:

Importation of goods on a temporary basis: The Sydney 2000 Olympic Games and associated events

 “125A.(1) Under paragraph 162A (1) (d) of the Act, the regulations may provide that goods imported for a specified purpose may be brought into Australia on a temporary basis without payment of duty.

 “(2) For paragraph 162A (1) (d), goods may be brought into Australia to be used in, or for purposes related to, The Sydney 2000 Olympic Games.

(3) For paragraph 162A (1) (d), goods may be brought into Australia to be used in, or for purposes related to, the Sydney 2000 Paralympic Games.

 “(4) For paragraph 162A (1) (d), goods may be brought into Australia to be used in, or for purposes related to, either of the following events in the Sydney Cultural Olympics:

  • (a)

    the event known as A Sea Change, to be held in 1998;

  • (b)

    the event known as Harbour of Life, to be held in 2000.

(5) For paragraph 162A (1) (d), goods may be brought into Australia to be used in, or for purposes related to, any of the events mentioned in the following table.

“[NOTE:  The events mentioned in the table are events significant to The Sydney 2000 Olympic Games.]

7 International Invitation proposed to be held in October 1999 (canoeing, kayaking and slalom)

8 Modern Pentathlon World Cup proposed to be held in October 1999

9 Fencing World Cup proposed to be held in October 1999

10 Oceania Championships proposed to be held in November 1999 (road race, track, and time trial for cycling)

11 Inter-Continental Cup proposed to be held in November 1999 (baseball)

12 National Basketball League matches at the Indoor Sport and Entertainment Centre, Sydney, proposed to be held in 1999 and 2000

13 Football International Invitations proposed to be held in conjunction with Soccer Australia from January to March 2000 (men’s and women’s matches)

14 World Cup proposed to be held in March 2000 (shooting)

15 International Triathlon Union World Cup proposed to be held in April 2000”.

4.   Regulation 125B (Dealing with goods brought into Australia under section 162A of the Act)

4.1   Subregulation 125B (2):

Omit the subregulation.

5.   Regulation 138A (Review by Administrative Appeals Tribunal)

5.1   Paragraph 138A (a):

Omit the paragraph.
