REGULATIONS UNDER THE CUSTOMS ACT 1901-1936.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1936.

Amendments of the Customs Regulations.

1. After regulation 31 of the Customs Regulations the following regulation is inserted:—

Notification of arrival.

“31a. The master of every ship and the pilot of every aircraft arriving from overseas shall give to the Customs officer in charge of the port or aerodrome three hours’ notice of his expected time of arrival at the first stopping place in the Commonwealth.”.

2. Regulation 32 of the Customs Regulations is repealed and the following regulation inserted in its stead:—

Inwards reports of ships and aircraft.

“32.—(1) The report required by section 64 of the Act shall be in accordance with Form 1 (Ships) or Form 1a (Aircraft). Application to amend the inward manifest report of a vessel shall be in accordance with Form 2. A list of stores shall be furnished with Form l and shall be in accordance with Form 3. A list of aircraft stores, where required, shall be shown on Form 1a. A list of customable articles and opium owned by the master, officers and crew of the ship or aircraft shall also accompany Form 1 and 1a and shall be in accordance with Form 5.

“(2) Where stores are consumed in Australian ports or in Australian waters or between Australian aerodromes, particulars of all stores so consumed shall, where required, be furnished by the Master of the ship or the Pilot of the aircraft on Form 3 or in such form as the Collector directs.”.

3. Regulation 99 of the Customs Regulations is amended by adding at the end thereof the following sub-regulation:—

“(2) The entry of an aircraft outwards shall be in accordance with Form 1a.”.

4. Regulation 101 of the Customs Regulations is repealed and the following regulation inserted in its stead:—

Outward manifest of ships and aircraft.

“101.—(1) The outward manifest of a ship shall be in accordance with Form 39.

“(2) The outward manifest of an aircraft shall be in accordance with Form 1a.”.

5. Regulation 103 of the Customs Regulations is repealed and the following regulation inserted in its stead:—

Clearance of ships and aircraft.

“103.—(1) The Certificate of Clearance to be issued to the Master of a ship shall be in accordance with Form 41.

(2) Form 1a, when stamped with an official stamp and signed by the Customs officer, shall constitute the Certificate of Clearance of the Pilot of an aircraft.”.

6. The Schedule to the Customs Regulations is amended by inserting, after Form 1, the following Form:—

1. Passenger Manifests and Cargo Manifests may be attached hereto. If they are not attached, the full information required in the above manifests must be furnished, if required by the laws and regulations of the country in which this document is filed.

2. If copies of air waybills/consignment notes are attached, their numbers shall be entered on an attached cargo manifest if it is furnished; otherwise, in the column provided in the above cargo manifest.

3. If the airline or operator consolidates a shipment with other shipments, or encloses the goods in other wrappers or containers, either separately or with other goods, the changes in packing and/or marks and numbers must be clearly stated in the air waybill/consignment note.

4. This General Declaration and/or attached manifests or air waybills should not bear erasures or corrections except those approved by the proper public authorities concerned nor contain interlineations or several listings on the same line. As many extra sheets may be added as necessary.

(Note.—Before departure the aircraft commander or authorized agent shall deliver to the public authorities concerned four copies of this General Declaration, one to be signed and returned to the aircraft commander, constituting his outward clearance.

On arrival, the aircraft commander or authorized agent shall deliver to the public authorities concerned five copies of this General Declaration.)
