REGULATIONS UNDER THE CUSTOMS ACT 1901-1957.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901-1957.

Amendments of the Customs Regulations. 

1. Regulations 8 to 18 (inclusive) of these Regulations shall come into operation on the first day of January, 1958.

2. Regulation 6 of the Customs Regulations is amended by omitting the words “ and the applicant furnishes security in such form and in such amount as the Collector approves,”.

3. Regulation 32 of the Customs Regulations is amended—

(a) by omitting from sub-regulation (1.) all the words from and including the words “A list of customable articles” and inserting in their stead the words “A list, in accordance with Form 5, showing the articles referred to in that Form owned by, or in the possession of, the master, officers and crew of the ship or aircraft shall also accompany Form 1 or Form 1a.” ; and

(b)by adding at the end thereof the following sub-regulation:—

“(3.) A person in charge of barber’s stock or stock in a ship’s shop or canteen shall furnish to the Collector at the final port of call of the ship a return in accordance with Form 5aa setting out in respect of such of the goods included in that stock on the arrival of the ship at its first port of call as were not sealed by an officer, or having been so sealed were released from seal—

(a)particulars of the whole of those goods;

(b)particulars of such of those goods as are on hand at the final port of call; and

(c) particulars of such of those goods as were consumed (including sold) in Australian ports or Australian waters.”.

4. Regulation 34 of the Customs Regulations is amended—

(a) by adding at the end of paragraph (a)of sub-regulation (3.) the word “or”;

(b) by omitting from paragraph (b)of sub-regulation (3.) the word “or”; and

(c) by omitting paragraph (c) of sub-regulation (3.).

5. Regulation 39 of the Customs Regulations is amended by omitting from sub-regulation (1.) the words “in triplicate” and inserting in their stead the words “in duplicate”.

6. Regulation 40 of the Customs Regulations is amended by omitting sub-regulation (2.).

7. Regulation 46 of the Customs Regulations is amended by omitting the words “, and shall give security in such amount as the Collector requires. Security shall be in accordance with Form 74, unless the transaction is covered by security already given in Form 68a, 75, 76 or 77”.

8. Regulation 50 of the Customs Regulations is amended by omitting the figures “550”, “400”, “275”, “50”, “75”, “100” and “125” and inserting in their stead the figures “880”, “640”, “440”, “80”, “120”, “160” and “200” respectively.

9. Regulation 51 of the Customs Regulations is amended by omitting the figures “400” and “250” and inserting in their stead the figures “640” and “440” respectively.

10. Regulation 53 of the Customs Regulations is amended by omitting the figures “£1 10s.” and inserting in their stead the words “Three pounds”.

11. Regulation 53a of the Customs Regulations is amended by omitting the words “Three pounds” and inserting in their stead the words “Six pounds”.

12. Regulation 53b of the Customs Regulations is amended by omitting the words “Five pounds” and inserting in their stead the words “Ten pounds”.

13. Regulation 55 of the Customs Regulations is amended—

(a) by omitting from sub-regulation (1.) the figures “550”, “400” and “275” and inserting in their stead the figures “880”, “640” and “440” respectively; and

(b)by omitting from sub-regulation (2.) the figures “400” and “250” and inserting in their stead the figures “640” and “440” respectively.

14. Regulation 56 of the Customs Regulations is amended by omitting from sub-regulation (1.) the figures “25”, “35”, “50” and “55” and inserting in their stead the figures “40”, “60”, “80” and “100” respectively.

15. Regulation 57 of the Customs Regulations is amended—

(a) by omitting from sub-regulation (1.) the figures “550”, “400” and “275” and inserting in their stead the figures “880”, “640” and “440” respectively; and

(b)by omitting from sub-regulation (2.) the figures “400” and “250” and inserting in their stead the figures “640” and “440” respectively.

16. Regulation 58 of the Customs Regulations is amended—

(a) by omitting from paragraph (a)the words “One pound ten shillings” and inserting in their stead the words “Three pounds”; and

(b) by omitting from paragraph (b)the words “Seven pounds ten shillings” and inserting in their stead the words “Fifteen pounds”.

17. Regulation 59 of the Customs Regulations is amended by omitting from sub-regulation (2.) the figures “£7 10s.” and inserting in their stead the words “Fifteen pounds”.

18. Regulation 61 of the Customs Regulations is amended by omitting from sub-regulation (3.) the words “One pound ten shillings” and inserting in their stead the words “Three pounds”.

19. Regulation 84 of the Customs Regulations is repealed.

20. Regulation 111 of the Customs Regulations is amended—

(a) by omitting from paragraph (e) of sub-regulation (1.) the word “passed” and inserting in its stead the word “made”;

(b) by omitting from paragraph (f) of sub-regulation (1.) the word “passed” and inserting in its stead the word “made”; and

(c) by omitting from paragraph (b) of sub-regulation (2.) the words “and passed”.

21. Regulation 124 of the Customs Regulations is amended by omitting from sub-paragraph (iv) of paragraph (b)of sub-regulation (1.) the word “repair,”.

22. Regulation 136 of the Customs Regulations is amended by omitting paragraph (b).

23. Regulation 149 of the Customs Regulations’ is amended by omitting the words “(See also regulation 91.)”.

24. Regulation 152 of the Customs Regulations is amended by omitting paragraph (a).

25. Regulation 188 of the Customs Regulations and the heading and section reference immediately preceding that regulation are repealed.

26. Regulation 198 of the Customs Regulations is amended by omitting paragraph (c) and inserting in its stead the following paragraph:—

“(c) any action, either by way of signing a form of declaration or otherwise, to be taken by a person concerned in the transaction or matter in or in relation to which the document is used or by his authorized agent;”.

27. Form 1a in the Schedule to the Customs Regulations is amended—

(a) by omitting the words “Marks and Numbers on Packages” and inserting in their stead the words “Air Waybill Number”;

(b) by omitting the words “Number and Type of Packages” and inserting in their stead the words “Number of Packages”; and

(c)by omitting the column headed “Gross Weight.”.

28. Form 3 in the Schedule to the Customs Regulations is amended by omitting the word “Onmopon” and inserting in its stead the word “Omnopon”.

29. Form 5 in the Schedule to the Customs Regulations is repealed and the following form inserted in its stead:—

and other narcotic drugs, owned by or in the possession of myself and of all the officers and members of my crew, at the time of entry into the

Port of . I further declare that the meaning of the requirements of this form has been fully explained to every person whose name,

signature, mark or thumbprint appears thereon.

INSTRUCTIONS TO MASTERS.

This list must be completed in readiness to be handed to the Customs Officer who first visits the vessel. It must be signed by every member of the crew (including the Master and Officers). Each person must state opposite his signature, mark or thumbprint the quantity of customable articles, opium, cocaine and other narcotic drugs, in his possession, including any goods or articles intended for another person. If he has nothing, he must state “ Nil ” or “ Nothing ”.

In the case of articles held for sale on the ship (other than bar stock, being ships’ stores, in the charge of the Chief Steward or other officer of the ship) full details of such articles must be shown on this list against the signature of the person in charge thereof.

All articles reported on this list must be produced and, if necessary, placed in a secure place to be sealed up by a Customs Officer.

Bona fide personal effects of a trifling nature, in use in the cabins of Masters, Officers and crew, need not be reported on the list, but wireless sets, musical instruments, firearms, ammunition, weapons, gramophones, gramophone records (number), typewriters, binoculars and cameras must be declared and values, numbers and other required particulars shown.

thumbprints, appear herein, declare that we have in our possession, respectively, the quantity of customable articles, opium, cocaine and other narcotic drugs, and no more, placed opposite our signatures, marks or thumbprints; and we severally undertake that neither these goods nor any portion thereof will be landed without authority of the Customs. The goods we now produce are to be placed under Customs seal if necessary.
