Customs Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Commencement

1. These Regulations shall come into operation on 21 December 1983.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Customs Regulations.

Deposits by subscribers to Customs securities

3. Regulation 25 of the Principal Regulations is amended by omitting from sub-regulation (1a) “passing any entry in relation thereto” and substituting “giving any authority under section 39 of the Act to deal with the goods”.

Fees for transactions involving the movement of goods out of warehouses

4. Regulation 52 of the Principal Regulations is amended––

(a) by inserting in sub-regulation (1) “dutiable” before “goods”;

(b) by omitting paragraph (1)(a) and substituting the following paragraph:

“(a) where an entry for home consumption has been made in respect of goods warehoused in the warehouse—the giving of an authority under section 39 of the Act for the goods to be dealt with in accordance with the entry;”;

(c) by omitting paragraph (4)(c) and substituting the following paragraph:

“(c) in relation to each of those entries for home consumption—an authority is given under section 39 of the Act for the goods to which the entry relates to be dealt with in accordance with the entry,”;

(d) by omitting from sub-regulation (4) “the passing of”; and

(e) by omitting from sub-regulation (4) “transaction” and substituting “entry for home consumption”.

Schedule

5. The Schedule to the Principal Regulations is amended by omitting from paragraph 3 in Form 45aa “pass any entry relating thereto” and substituting “give any authority under section 39 of the Customs Act 1901 to deal with them”.
