Customs Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Customs Act 1901.

Regulation 138b of the Customs Regulations is repealed and the following regulation substituted:

Notification of decision

“138b. (1) Where the Comptroller makes a decision of a kind referred to in sub-regulation 138a (1), the Comptroller shall give written notice of the decision to the person or persons whose interests are affected by the decision.

“(2) A notice by the Comptroller under sub-regulation (1) shall include a statement to the effect that, subject to the Administrative Appeals Tribunal Act 1975,application may be made to the Administrative Appeals Tribunal for review of the decision to which the notice relates by or on behalf of the person or persons whose interests are affected by the decision.

“(3) Any failure to comply with the requirement of sub-regulations (1) or (2) in relation to a decision does not affect the validity of the decision.”.
