Customs Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Interpretation of regulations 181, 182 and 183

1. Regulation 180 of the Customs Regulations is amended by omitting “and ‘particular goods’ ” and substituting “, ‘particular goods’ and ‘repair’ ”.

Application: particulars prescribed

2. Regulation 181 of the Customs Regulations is amended:

(a) by omitting from paragraph (1) (p) “the name” and substituting “where the application is for an order provided for by subsection 269c (1) of the Act—the name”;

(b) by omitting from paragraph (1) (s) “the extent” and substituting “where the application is for an order provided for by subsection 269c (1) of the Act—the extent”;

(c) by inserting in paragraph (1) (t) “the application is for an order provided for by subsection 269c (1) of the Act and” after “where”;

(d) by omitting from paragraph (1) (t) “and” (last occurring);

(e) by inserting after paragraph (1) (t) the following paragraph:

“(ta) where the application is for an order provided for by subsection 269c (1a) or (1b) of the Act:

(i) a description of the repairs to be made to the goods;

(ii) the name and business address of each person in Australia with whom the applicant has communicated in writing for the purpose of determining whether the person is capable of repairing the goods in the normal course of business;

(iii) a copy of each communication sent by the applicant to a person for the purpose referred to in subparagraph (ii);

(iv) the original of each reply received by the applicant to each communication referred to in subparagraph (iii); and

(v) the extent to which the goods are capable of being repaired by a person in Australia in the normal course of business; and”;

(f) by omitting from paragraph (2) (a) “Department at the Edmund Barton Building,” and substituting “Customs in”;

(g) by omitting from paragraph (2) (b) “Department at the Edmund Barton Building,” and substituting “Customs in”;

(h) by inserting in paragraph (2) (b) “, facsimile message” after “telex message”;

(i) by omitting paragraph (2) (c) and substituting the following paragraph:

“(c) where an individual lodges it in person—by delivering it to the Assistant Comptroller-General of the Tariff Concession and Quota Branch of the Customs in Canberra or with a person whom the individual believes on reasonable grounds to be acting on behalf of that Assistant Comptroller-General.”; and

(j) by omitting from subregulation (5) “Department” and substituting “Customs”.

Notices under subsection 269h of the Act: matters prescribed

3. Regulation 182 of the Customs Regulations is amended:

(a) by omitting from paragraph (2) (a) “Department at the Edmund Barton Building,” and substituting “Customs in”;

(b) by omitting from paragraph (2) (b) “Department at the Edmund Barton Building,” and substituting “Customs in”;

(c) by inserting in paragraph (2) (b) “, facsimile message” after “telex message”;

(d) by omitting paragraph (2) (c) and substituting the following paragraph:

“(c) where an individual lodges it in person—by delivering it to the Assistant Comptroller-General of the Tariff Concession and Quota Branch of the Customs in Canberra or with a person whom the individual believes on reasonable grounds to be acting on behalf of that Assistant Comptroller-General.”; and

(e) by omitting from subregulation (3) “Department” and substituting “Customs”.

Interpretation of regulation 185 and Schedule 2

4. Regulation 184 of the Customs Regulations is amended by omitting “and (7)” and substituting “, (7) and (8)”.

Schedule 2

5. Schedule 2 to the Customs Regulations is amended:

(a) by inserting in Column 3 in item 1 “Fatty alcohols falling within tariff item 15.10”;

(b) by omitting from Column 2 in item 6 “48.21.3” and substituting “48.21.2”; and

(c) by omitting item 32 and substituting the following item:

“32 83.06 Photograph, picture and similar frames of base metal and mirrors of base metal”,
