Customs Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Commencement

1. (1) Regulations 2 and 3 shall come into operation on 1 August 1987.

(2) Regulation 4 shall come into operation on 2 August 1987.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Customs Regulations.

3. After regulation 127 of the Principal Regulations the following regulation is inserted:

Rebate not payable in respect of certain diesel fuel

“127a. A rebate is not payable to a person under subsection 164 (1) of the Act in respect of diesel fuel purchased by the person earlier than 12 months before 1 August 1987, being the date of the repeal of subregulation 127 (7).”.

Conditions etc. in relation to payment of rebate—subsection 164 (1) of the Act

4. Regulation 128d of the Principal Regulations is amended:

(a) by omitting subparagraph (1) (e) (v); and

(b) by inserting after subparagraph (2) (a) (viii) the following subparagraph:

“(viiia) where a person other than the applicant is involved, or likely to be involved, in the use of the fuel to which the application relates—the name, address and occupation of that person and the quantity in litres of that fuel that is or is likely to be used by that person;”.
