I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Commencement

1. These Regulations shall come into operation on 1 January 1988.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Customs Regulations.

Entry for export—required particulars

3. Regulation 99 of the Principal Regulations is amended by omitting from paragraphs (2) (1) and (2) (m) respectively “Australian Export Commodity Classification” and substituting “Australian Harmonized Export Commodity Classification”.

Particulars required of goods exempted from entry for export

4. Regulation 99a of the Principal Regulations is amended by omitting from paragraphs (j) and (k) respectively “Australian Export Commodity Classification” and substituting “Australian Harmonized Export Commodity Classification”.

5. Regulation 99b of the Principal Regulations is amended by omitting

subregulation (1) and substituting the following subregulation:

“ (1) A reference in regulation 99, 99λ or 100 to the Australian Harmonized Export Commodity Classification is a reference to the document known as the Australian Harmonized Export Commodity Classification published by the Australian Bureau of Statistics as in force on 1 January 1988.”.

Goods exempted from entry for export

6. Regulation 100 of the Principal Regulations is amended by omitting from paragraph (1) (c) “Australian Export Commodity Classification” and substituting “Australian Harmonized Export Commodity Classification”.

Interpretation of regulation 185 and Schedule 2

7. Regulation 184 of the Principal Regulations is amended by omitting subregulation (3) and substituting the following subregulation:

“ (3) A reference in regulation 185 and Schedule 2 to a heading or a subheading is a reference to a heading or a subheading, as the case may be, in Schedule 3 to the Customs Tariff Act 1987 and includes a reference to any subheading listed under such a heading or subheading.”.

8. Regulation 185 of the Principal Regulations is repealed and the following Regulation substituted:

Restrictions on concession orders

“ 185. For the purposes of subsection 269d (1) of the Act, the particular goods in respect of which a concession order shall not be made are goods classified under a heading or subheading referred to in Column 2 of an item in Schedule 2 other than any goods described in Column 3 of that item in that Schedule.”.

Schedule 2

9. Schedule 2 to the Principal Regulations is repealed and the following Schedule substituted:
