Customs Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Customs Act 1901.

After regulation 23 of the Customs Regulations the following regulation is inserted:

Prescribed information: Torres Strait Treaty

“23aaa. For the purposes of subsection 30a (4) of the Act, a notice given by the master of a ship or the pilot of an aircraft, proposing to take that ship or aircraft, as the case may be, on a voyage or flight to which that subsection applies, shall set out the following information:

(a) the itinerary of that voyage or flight;

(b) if the notice relates to a voyage of a ship—the name of the ship;

(c) the registration number of the ship or aircraft;

(d) the place of registration of the ship or aircraft;

(e) the type and description of the ship or aircraft;

(f) the name and address of the owner of the ship or aircraft;

(g) if the ship or aircraft is under charter—the name and address of the charterer;

(h) in respect of each member of the crew of the ship or aircraft:

(i) the name;

(ii) the date of birth; and

(iii) the nationality;

of that member and whether the member is the master of the ship or the pilot of the aircraft;

(j) in respect of each traditional inhabitant who will be undertaking that voyage or flight:

(i) the name;

(ii) the place of embarkation; and

(iii) the place of disembarkation;

of that traditional inhabitant;

(k) in respect of each employee of the Commonwealth, of Queensland or of Papua New Guinea or of an authority of the Commonwealth, of Queensland or of Papua New Guinea who will be undertaking that voyage or flight in connection with the performance of his or her duties:

(i) the name;

(ii) the name of the employer; and

(iii) the nationality;

of that employee.”.
