Customs (Prohibited Imports) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs (Prohibited Imports) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2.   New regulation 5K

2.1   After regulation 5J, insert:

Importation of ozone-depleting substances

 “5K.(1)This regulation applies to goods mentioned in column 2 of an item in Schedule 10.

 “(2) However, this regulation does not apply to goods classified in Schedule 3 of the Customs Tariff Act 1995 under:

  • (a)

    heading 3004 (‘Medicaments (excluding goods of 3002, 3005 or 3006) consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packings for retail sale’); or

  • (b)

    Chapter 39 (‘Plastics and articles thereof’); or

  • (c)

    Chapter 84 (‘Nuclear reactors, boilers, machinery and mechanical appliances; parts thereof’).

 “(3) The importation into Australia of goods to which this regulation applies is prohibited unless the Minister for the Environment has granted a licence to import the goods under section 16 of the Ozone Protection Act 1989 and the licence, or a copy of the licence, is produced to a Collector.”.

3.   New Schedule 10

3.1   After Schedule 9, insert:
