Customs (Prohibited Imports) Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Principal Regulations

1. In these Regulations “Principal Regulations” means the Customs (Prohibited Imports) Regulations.

Importation of therapeutic substances

2. Regulation 5a of the Principal Regulations is amended by adding at the end the following subregulation:

“(8) In this regulation, ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of this regulation.”.

Licensed importers

3. Regulation 5b of the Principal Regulations is amended by adding at the end the following subregulation:

“(5) In this regulation, ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of this regulation.”.

Designated therapeutic substances

4. Regulation 5c of the Principal Regulations is amended by inserting before the definition of “exempt therapeutic substance” in subregulation (1) the following definition:

“ ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of regulation 5e:”.

Conditions of licences under regulation 5b

5. Regulation 5d of the Principal Regulations is amended by adding at the end the following subregulation:

“(6) In this regulation ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of regulation 5e.”.

Disposal of designated therapeutic substances

6. Regulation 5e of the Principal Regulations is amended by adding at the end the following subregulation:

“(6) In this regulation, ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of this regulation.”.

Reasons for refusal to be given

7. Regulation 5f of the Principal Regulations is amended by adding at the end the following subregulation:

“(4) In this regulation, ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of regulation 5a, 5b or 5e, as the case requires.”.

Appeals

8. Regulation 5g of the Principal Regulations is amended by adding at the end the following subregulation:

“(10) In this regulation, ‘authorised person’ means a person authorised in writing by the Secretary of the Department of Community Services and Health to be an authorised person for the purposes of regulation 5a, 5b or 5e, as the case requires.”.

Further amendments

9. The Principal Regulations are amended as set out in the Schedule.

 

SCHEDULE Regulation 9

FURTHER AMENDMENTS OF PRINCIPAL REGULATIONS

1. The following provisions of the Principal Regulations are amended by inserting “or an authorised person” after “Secretary of the Department of Community Services and Health”:

Subregulations 5a (1), 5a (3), 5b (1), 5b (2) (first occurring), 5b (2a) (first occurring), 5b(2c), 5b (4) and 5c (4), subparagraph 5d (1) (b) (i), subregulations 5e (2), 5e (3), 5e (3a), 5e (4) (first and second occurring), 5f (1) (first occurring), 5f (3) (first occurring), 5g (1), 5g (2), 5g (3), 5g (4) (first occurring), 5g (5) (first occurring) and 5g (8) (first and third occurring).

2. The following provisions of the Principal Regulations are amended by inserting “or authorised person” after “Secretary of the Department of Community Services and Health”:

Subregulation 5a (4), paragraphs 5b (2) (a) and (b) and 5b (2a) (b) (wherever occurring), subregulation 5e (4) (third, fourth and sixth occurring), subregulation 5f (1) (second occurring), paragraphs 5f (2) (a) and (b), subregulations 5f (3) (second occurring), 5g (5) (second and third occurring) and 5g (8) (second occurring).
