Customs (Prohibited Imports) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs (Prohibited Imports) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 2 (Interpretation)

2.1   Subregulation 2 (1) (definition of “exempt firearm”, sub-subparagraph (c) (i) (A)):

Omit the sub-subparagraph.

2.2   Subregulation 2 (1) (definition of “exempt firearm”, sub-subparagraph (c) (i) (H)):

Omit the sub-subparagraph, substitute:

  • “(H)

    rim-fire self-loading rifle unless fitted, or capable of being fitted, with a magazine having a capacity of more than 10 rounds;”.

2.3   Subregulation 2 (1) (definition of “exempt firearm”, sub-subparagraph (c) (ii) (A)):

Omit the sub-subparagraph, substitute:

  • “(A)

    repeating shotgun, whether self-loading or pump-action, unless fitted, or capable of being fitted, with a magazine having a capacity of more than 5 rounds;”.

2.4   Subregulation 2 (1) (definition of “exempt firearm”, subparagraph (c) (v)):

Omit the subparagraph, substitute:

  • “(v)

    a self-loading centre-fire rifle or a self-loading centre-fire carbine;”.

3.   Schedule 3 (Goods the importation of which is prohibited unless specified conditions, restrictions or requirements are complied with)

3.1   Schedule 3:

After item 7, insert:

“8

Detachable magazines, having a capacity of more than 10 rounds, for rim-fire self-loading rifles

The importer must produce to a Collector, at or before importation, a certificate that:

(a) states that the detachable magazines are for use for official purposes; and

(b) is signed by the Minister for Justice or a Minister responsible for police in a State or Territory”.
