Customs (Prohibited Imports) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs (Prohibited Imports) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 4F (Importation of firearms, firearm accessories, firearm parts, firearm magazines and ammunition)

2.1   Subregulation 4F (3):

Omit “set out in Part 3 of Schedule 6”, insert “, set out in item 2 of Part 3 of Schedule 6,”.

3.   Schedule 6 (Requirements for the importation of firearms, firearm accessories, firearm parts, firearm magazines and ammunition)

3.1   Schedule 6, Part 2, item 1:

Add at the end of column 3 of the item:

“If item 1 of Part 3 of this Schedule applies to the firearm, the firearm must comply with the safety requirements set out in the item.”.

3.2   Schedule 6, Part 2, item 2:

Add at the end of column 3 of the item:

“If item 1 of Part 3 of this Schedule applies to the firearm, the firearm must comply with the safety requirements set out in the item.”.

3.3   Schedule 6, Part 2, item 3:

Add at the end of column 3 of the item:

“If item 1 of Part 3 of this Schedule applies to the firearm, the firearm must comply with the safety requirements set out in the item.”.

3.4   Schedule 6, Part 2, item 6:

Add at the end of column 3 of the item:

“If item 1 of Part 3 of this Schedule applies to the firearm, the firearm must comply with the safety requirements set out in the item.”.

3.5   Schedule 6, Part 2, item 9:

Add at the end of column 3 of the item:

“If item 1 of Part 3 of this Schedule applies to the firearm, the firearm must comply with the safety requirements set out in the item.”.

3.6   Schedule 6, Part 3, paragraph 1.4 (c):

Omit “subparagraph (b) (i)—”, substitute “subparagraph (a) (i)—”.

3.7   Schedule 6, Part 3, paragraph 1.4 (d):

Omit “subparagraph (b) (ii)—”, substitute “subparagraph (a) (ii)—”.

3.8   Schedule 6, Part 3, subitem 1.5:

Omit “A firearm to which the safety requirements apply”, substitute “Any firearm, other than a firearm to which the safety requirements do not apply because of subitem 1.1, 1.2, 1.3 or 1.4,”.

3.9   Schedule 6, Part 3, subitem 1.5:

Omit “items 1.6 to 1.9 (inclusive),”, substitute “subitems 1.6 to 1.9 (inclusive),”.
