1Name

This instrument is the Customs (Prohibited Imports) Amendment (Weapons) Regulations 2019.

  1. (1)

    Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Customs Act 1901.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Customs (Prohibited Imports) Regulations 1956

Subparagraph 3A(a)(xiv)

Omit “Tonga;”, substitute “Tonga; and”.

Subparagraphs 3A(xv) and (xvi)

Repeal the subparagraphs.

Regulation 3B

Repeal the regulation.

Repeal the subregulation.

After paragraph 2.2(c) of Part 1 of Schedule 13

Insert:

  1. (d)

    the good is a flamethrower, or similar device, of a kind mentioned in item 46 of Part 2 of this Schedule, or a part mentioned in item 47 of that Part, to be imported in the following circumstances:

    1. (i)

      either:

      1. (A)

        for use in an entertainment production or performance approved by the State or Territory in which the good is to be used; or

      2. (B)

        for the purpose of fire prevention or fire control activities approved by the State or Territory in which the good is to be used;

    2. (ii)

      if the importer is required to hold a licence or authorisation to possess the good in the State or Territory in which the good is to be used—the importer holds a licence or authorisation of that kind; or

Omit “Flame throwers”, substitute “Flamethrowers”.

(b) a tensioning, locking or triggering device, or similar component, designed or adapted to assist in propelling a projectile
