I, PHILIP MICHAEL JEFFERY, Governor‑General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

Name of Regulations
These Regulations are the Customs (Prohibited Imports) Amendment Regulations 2008 (No. 4).

Commencement
These Regulations commence on the day after they are registered.

Amendment of Customs (Prohibited Imports) Regulations 1956
Schedule 1 amends the Customs (Prohibited Imports) Regulations 1956.

| 1 | Anti‑personnel sprays and chemicals for use in the manufacture of anti‑personnel sprays |
The goods must not be imported unless: (a) the following circumstances exist: (i) the written consent of the Minister, the Commissioner of the Australian Federal Police or the commissioner (however designated) of the police force of a State or Territory, is produced to a Collector; |

(ii) the goods are imported: (A) for the purposes of the government of the Commonwealth, including the use of the Australian Federal Police; or |
||
| (B) for the use of a police force of a State or Territory, or a correctional institution of a State or Territory; or | ||
| (C) for the use of the Office of the Sheriff of New South Wales; or | ||
| (D) for the use of the Department of Primary Industries of Victoria; or | ||
| (E) for the use of the Department of Sustainability and Environment of Victoria; or | ||
| (F) for the use of the Office of Police Integrity of Victoria; or | ||
| (G) for the use of the Department of Primary Industries and Resources of South Australia; or | ||
|
(b) the following circumstances exist: (i) the goods are imported as part of a contract to which a person in Australia is a party; |
||
|
(ii) the person made the contract with the intention of supplying the goods to: (A) the United Nations; or (B) the government of a country other than Australia; in a manner that will not contravene Australia’s international obligations; |
||
| (iii) the contract is in force when the goods are imported | ||
| 1A | Grenades or canisters, designed for use with anti‑personnel sprays or anti‑personnel chemicals |
The goods must not be imported unless: (a) the following circumstances exist: (i) the written consent of the Minister, the Commissioner of the Australian Federal Police or the commissioner (however designated) of the police force of a State or Territory, is produced to a Collector; |
