Customs (Prohibited Exports) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs (Prohibited Exports) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2.   New regulation 13F

2.1   After regulation 13E, insert:

Exportation of ozone-depleting substances

 “13F.(1)This regulation applies to goods mentioned in column 2 of an item in Schedule 15.

 “(2) However, this regulation does not apply to goods classified in Schedule 3 of the Customs Tariff Act 1995 under:

  • (a)

    heading 3004 (‘Medicaments (excluding goods of 3002, 3005 or 3006) consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packings for retail sale’); or

  • (b)

    Chapter 39 (‘Plastics and articles thereof’); or

  • (c)

    Chapter 84 (‘Nuclear reactors, boilers, machinery and mechanical appliances; parts thereof’).

 “(3) The exportation from Australia of goods to which this regulation applies is prohibited unless the Minister for the Environment has granted a licence to export the goods under section 16 of the Ozone Protection Act 1989 and the licence, or a copy of the licence, is produced to a Collector.”.

3.   New Schedule 15

4.   Further amendments

4.1   The Regulations are further amended by omitting “Comptroller” in each of the following provisions and substituting “CEO”:

  • (a)

    paragraph 10B (1) (c) (twice occurring);

  • (b)

    paragraph 10B (1) (e);

  • (c)

    regulation 10E.

[Note:  The heading to regulation 10E is taken to be amended to read “Exercise of powers by Secretary, CEO or authorised person”.]
