I, T H E G O V E R N O R - G E N E R A L of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Prohibition against export except with approval of Minister of State for

Home Affairs and Environment

1. Regulation 13A of the Customs (Prohibited Exports) Regulations is

amended by inserting after sub-regulation ( 1 A ) the following sub-regulation:

"(1B) In the Twelfth Schedule—

(a)

a reference to a copy of a cinematograph film or of a sound recording or to the publication of a cinematograph film or of a sound recording has the same meaning as a similar reference in the Copyright Act 1968; and

(b)

a reference to Australia, in relation to the performance of any act or the doing of any thing, includes a place that—

(i) was, at the time of the performance of that act or the doing of that thing; or

(ii) became, after that time,

an external Territory, whether or not that place has subsequently

ceased to be an external Territory.".

Twelfth Schedule

2 . The Twelfth Schedule to the Customs (Prohibited Exports) Regulations

is amended by adding at the end thereof the following item:

"6 A copy of a cinematograph film or of a sound recording, being a

cinematograph film or sound recording that—

(a)

was made in Australia not less than 40 years before the exportation, or proposed exportation, of that copy; and

(b)

has been at any time published in Australia or elsewhere".
