Customs (Prohibited Exports) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Commencement

1. Regulations 3 and 6 shall come into operation on 1 June 1987.

Export of goods specified in Schedule 13

2. Regulation 13b of the Customs (Prohibited Exports) Regulations is amended by omitting from subregulation (1) and paragraph (2) (a) “Support”.

Exportation of goods to Namibia or the Republic of South Africa

3. Regulation 13c of the Customs (Prohibited Exports) Regulations is amended by inserting “Namibia or” after “Australia to” in subregulations (1) and (2).

4. After regulation 13c of the Customs (Prohibited Exports) Regulations the following regulation is inserted:

Export of goods containing certain chemical compounds

“13d. (1) In this regulation:

‘authorised person’ means a person authorised in writing by the Minister of State for Foreign Affairs to grant, for the purposes of this regulation, permission to export prescribed goods from Australia;

‘Chemical Abstracts Service number’, in relation to a chemical compound, means the registry number:

(a) assigned to that compound by the Chemical Abstracts Service, Columbus, Ohio, United States of America; and

(b) published by that Service in the journal ‘Chemical Abstracts’;

‘prescribed goods’ means goods containing 10% or more, by weight, of a chemical compound, specified in column 2 in an item in Schedule 15, whose Chemical Abstracts Service number is specified in column 3 of that Schedule in that item.

“(2) The exportation from Australia of prescribed goods is prohibited unless.

(a) the Minister of State for Foreign Affairs or an authorised person grants permission in writing to export the goods; and

(b) that permission is produced to the Collector.

“(3) A permission granted under subregulation (2) may specify conditions, or requirements, to be complied with by the holder of the permission and may, in respect of any such condition or requirement, specify a time (being a time before or after the exportation of the goods to which the permission relates) at or before which the condition or requirement shall be complied with by the holder.

“(4) Where:

(a) a permission granted under subregulation (2) is subject to a condition, or requirement, to be complied with by a person; and

(b) the person fails to comply with the condition or requirement;

the Minister or an authorised person may revoke the permission whether or not the person is charged with an offence against subsection 112 (2b) of the Act in respect of the failure to comply with the condition or requirement.”.

Schedule 13

5. Schedule 13 to the Customs (Prohibited Exports) Regulations is amended:

(a) by omitting from the heading “SUPPORT”; and

(b) by omitting item 33.

Schedule 14

6. Schedule 14 to the Customs (Prohibited Exports) Regulations is amended by inserting in the heading “NAMIBIA OR” after “WHICH TO”.

Schedule 15

7. The Customs (Prohibited Exports) Regulations are amended by adding at the end the following Schedule:
