Customs (Prohibited Exports) Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Commencement

1. These Regulations shall come into operation on 1 January 1988.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Customs (Prohibited Exports) Regulations.

Prohibition against exportation of certain goods

3. Regulation 9 of the Principal Regulations is amended by omitting subregulation (4).

Exportation of goods to Namibia or the Republic of South Africa

4. Regulation 13c of the Principal Regulations is amended by adding at the end following subregulation:

“(3) For the purposes of item 8 in Schedule 14:

‘petroleum’ means:

(a) any naturally occurring hydrocarbon, whether in a gaseous, liquid or solid state;

(b) any naturally occurring mixture of hydrocarbons, whether in a gaseous, liquid or solid state; or

(c) any naturally occurring mixture of hydrocarbon or hydrocarbons, whether in a gaseous, liquid or solid state, and one or more of the following, that is to say, hydrogen sulphate, nitrogen, helium and carbon dioxide;

‘petroleum product’ means:

(a) any hydrocarbon or mixture of hydrocarbons produced by subjecting petroleum to a process of refining or produced from petroliferous minerals; or

(b) any mixture of a hydrocarbon or hydrocarbons so produced with another substance or substances;

‘petroliferous mineral’ means any naturally occurring mineral from which any hydrocarbon, whether in the gaseous, liquid or solid state, may be produced.”.

First Schedule

5. The First Schedule to the Principal Regulations is amended by omitting items 2, 7 and 8.

Second Schedule

6. The Second Schedule to the Principal Regulations is amended by omitting item 6 and Part IV.

Sixth Schedule

7. The Sixth Schedule to the Principal Regulations is amended by omitting item 6.

Seventh Schedule

8. The Seventh Schedule to the Principal Regulations is amended:

(a) by omitting items 7, 9, 11, 12 and 18;

(b) by omitting item 4 and substituting the following item:

“4 Copper scrap and copper alloy scrap; basic shapes cast from copper scrap or copper alloy scrap”; and

(c) by adding at the end the following item:

“20 Liquefied petroleum gas and liquefied natural gas”.

Eighth Schedule

9. The Eighth Schedule to the Principal Regulations is amended by adding at the end of Part I the following items:

“70 Ketobemidone and its salts and preparations containing ketobemidone or any of its salts

71 Opium prepared for smoking, including dross and any other form of charred opium”.

Schedule 14

10. Schedule 14 to the Principal Regulations is amended by adding at the end the following item:

“8 Crude oil, petroleum and petroleum products”.
