Customs (Prohibited Exports) Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Customs Act 1901.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Customs (Prohibited Exports) Regulations.

Exportation of goods specified in the Third Schedule

2. Regulation 5 of the Principal Regulations is amended by omitting “Minister of State for Primary Industry” (wherever occurring) and substituting “Minister of State for Primary Industries and Energy”.

Exportation of goods specified in the Fifth Schedule

3. Regulation 7 of the Principal Regulations is amended by omitting “Department of Aviation” and substituting “Department of Transport and Communications”.

Exportation of goods specified in the Sixth Schedule

4. Regulation 8 of the Principal Regulations is amended by omitting “Department of Health” and substituting “Department of Community Services and Health”.

Prohibition against exportation of certain goods

5. Regulation 9 of the Principal Regulations is amended by omitting from paragraph (1) (a) “Minister of State for Trade” and substituting “Minister of State for Primary Industries and Energy”.

Conditions of licences under regulation 10a

6. Regulation 10b of the Principal Regulations is amended by omitting from subregulation (2) “Department of Health” and substituting “Department of Community Services and Health”.

Exportation of goods specified in the Ninth Schedule

7. Regulation 11 of the Principal Regulations is amended by omitting “Minister of State for Trade and Resources” (wherever occurring) and substituting “Minister of State for Primary Industries and Energy”.

Exportation of goods specified in the Tenth Schedule

8. Regulation 12 of the Principal Regulations is amended:

(a) by inserting in subregulation (1) “Foreign Affairs and” after “Department of”; and

(b) by inserting “Foreign Affairs and” after “Minister of State for” (wherever occurring).

Exportation of goods specified in the Twelfth Schedule

9. Regulation 13a of the Principal Regulations is amended by omitting from subregulations (1) and (2) “Minister of State for Arts, Heritage and Environment” and substituting “Minister of State for the Arts, Sport, the Environment, Tourism and Territories”.

Exportation of goods to Namibia or the Republic of South Africa

10. Regulation 13c of the Principal Regulations is amended by inserting “and Trade” after “Minister of State for Foreign Affairs” (wherever occurring).

Third Schedule

11. The Third Schedule to the Principal Regulations is amended by omitting from the heading “MINISTER OF STATE FOR PRIMARY INDUSTRY” and substituting “MINISTER REFERRED TO IN REGULATION 5”.

Fifth Schedule

12. The Fifth Schedule to the Principal Regulations is amended by omitting from the heading “DEPARTMENT OF AVIATION” and substituting “DEPARTMENT REFERRED TO IN REGULATION 7”.

Sixth Schedule

13. The Sixth Schedule to the Principal Regulations is amended by omitting from the heading “DEPARTMENT OF HEALTH” and substituting “DEPARTMENT REFERRED TO IN REGULATION 8”.

Seventh Schedule

14. The Seventh Schedule to the Principal Regulations is amended by omitting from the heading “MINISTER OF STATE FOR TRADE” and substituting “MINISTER REFERRED TO IN REGULATION 9”.

Ninth Schedule

15. The Ninth Schedule to the Principal Regulations is amended:

(a) by omitting from the heading “MINISTER OF STATE FOR TRADE AND RESOURCES” and substituting “MINISTER REFERRED TO IN REGULATION 11”; and

(b) by omitting item 15 and substituting the following item:

“15 Any:

(a) lithium;

(b) lithium hydrides;

(c) lithium alloys; or

(d) other materials (including compounds, mixtures and concentrates);

being or containing lithium enriched in the 6 isotope”.

Tenth Schedule

16. The Tenth Schedule to the Principal Regulations is amended by omitting from the heading “MINISTER OF STATE FOR TRADE” and substituting “MINISTER REFERRED TO IN REGULATION 12”.

Twelfth Schedule

17. The Twelfth Schedule to the Principal Regulations is amended by omitting from the heading “MINISTER OF STATE FOR ARTS, HERITAGE AND ENVIRONMENT” and substituting “MINISTER REFERRED TO IN REGULATION 13a”.

Schedule 14

18. Schedule 14 to the Principal Regulations is amended by omitting from the heading “MINISTER OF STATE FOR FOREIGN AFFAIRS” and substituting “MINISTER REFERRED TO IN REGULATION 13c”.

Further amendments

19. The provisions of the Principal Regulations specified in the Schedule are amended by omitting “Director-General of Health” (wherever occurring) and substituting “Secretary of the Department of Community Services and Health”.

Paragraph 10 (1) (b), subregulations 10 (2) and (3) and 10a (1), (2) and (4), paragraphs 10b (1) (b), (c), (d) and (e), subregulation 10b (2) and regulation 10e.
