Customs (Prohibited Exports) Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Customs Act 1901.

1.   Amendment

1.1   The Customs (Prohibited Exports) Regulations are amended as set out in these Regulations.

2.   New regulation 13cb

2.1   After regulation 13ca, insert:

Exportation of goods to Libya

“13cb. (1)  The exportation of goods:

(a)

that are goods of a kind specified in Schedule 14a; and

  • (b)

    the immediate or final destination of which is, or is intended to be, Libya;

is prohibited unless the written permission of the Minister of State for Foreign Affairs and Trade, or an authorised person, is first produced to a Collector.

“(2)

When deciding whether to give permission under subregulation (1), the Minister of State for Foreign Affairs and Trade, or the authorised person, must take into account Australia’s relations with other countries and its obligations under international law.

“(3)

A permission may be expressed to be subject to conditions, including:

(a)

the quantity of the goods that may be exported; and

  • (b)

    the circumstances in which the goods may be exported; and

(c)

the period of effect of the permission.

“(4)

In this regulation:

‘authorised person’ means an officer of the Department of Foreign Affairs and Trade authorised in writing by the Minister of State for Foreign Affairs and Trade for the purposes of this regulation; and

‘Libya’ means the Socialist People’s Libyan Arab Jamahiriya.”.

3.   Regulation 13h (Certain applications to be referred)

3.1   Paragraph 13h (1) (a):

Omit “13ca (2)”, substitute “13ca (2), 13cb (1)”.

3.2   Paragraph 13h (3) (a):

Omit “13ca (2)”, substitute “13ca (2), 13cb (1)”.

3.3   Paragraph 13h (4) (b):

Omit “13ca (2)”, substitute “13ca (2), 13cb (1)”.

4.   (Schedule 7)

4.1

 Schedule 7:

Omit item 5.

5.   New Schedule 14a

5.1   After Schedule 14, insert:
