Customs (Prohibited Exports) Regulations (Amendment) (Cth)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the
Federal Executive Council, make the following Regulations under the
Dated 11 May 1995.

1.1 The Customs (Prohibited Exports) Regulations are amended as set out in these Regulations.

2.1 Subregulation 13B (2):
Omit “subregulation (3) or (3A)”, substitute “subregulation (3), (3A) or (3B)”.
2.2 After subregulation 13B (3A), insert:
This subregulation applies to goods:
(a) the owner of which is the defence force of any of the following countries:
(i) Brunei Darussalam;
(ii) Canada;
(iii) Malaysia;
(iv) New Zealand;
(v) Papua New Guinea;
(vi) the Kingdom of Cambodia;
(vii) the Kingdom of Thailand;
(viii) the Republic of Fiji;
(ix) the Republic of Indonesia;
(x) the Republic of the Philippines;
(xi) the Republic of Singapore;
(xii) the United Kingdom;
(xiii) the United States of America;
(xiv) Tonga; and
(b) that have been imported into Australia by:
(i) the defence force that is the owner of the goods; or
(ii) a member of that defence force to whom the goods have been issued; and
(c) that are to be exported from Australia by:
(i) the defence force that is the owner of the goods; or
(ii) a member of that defence force to whom the goods have been issued.”.
3.1 Subregulation 13E (2):
Add at the end:
“; or (c) the goods:
(i) are goods the owner of which is the defence force of any of the following countries:
(A) Brunei Darussalam;
(B) Canada;
(C) Malaysia;
(D) New Zealand;
(E) Papua New Guinea;
(F) the Kingdom of Cambodia;
(G) the Kingdom of Thailand;
(H) the Republic of Fiji;
(I) the Republic of Indonesia;
(J) the Republic of the Philippines;
(K) the Republic of Singapore;
(L) the United Kingdom;
(M) the United States of America;
(N) Tonga; and
(ii) have been imported into Australia by:
(A) the defence force that is the owner of the goods; or
(B) a member of that defence force to whom the goods have been issued; and
(iii) are to be exported from Australia by:
(A) the defence force that is the owner of the goods; or
(B) a member of that defence force to whom the goods have been issued.”.
